Debt can also be transferred, but it must be agreed by the creditor. If the creditor does not agree, the debt transfer is illegal. There is a creditor-debtor relationship between you and the bank, and you are the debtor. If you want to transfer your debt, you must get the approval of the bank before the transfer is effective. If the bank approves, you sign a contract with the bank and the responsible party, and your debt will be transferred to your friend's name, otherwise the transfer will be invalid. There are two ways of debt transfer: complete transfer and compensation. 1. In case of complete transfer, the person who accepts the debt will be fully responsible for the debt, and the debtor will become the person who accepts the debt, and the person who accepts the debt will be responsible for repaying the debt. 2. In the case of compensation, the person who accepts the debt is responsible for repaying the debt, but the subject of the debt is still the original debtor. If there is a problem, the other party in the lawsuit is still the original debtor. Complete transfer means that both the debtor and the repayment party have transferred; The compensation is that the repayment party has shifted, but the debtor has not changed. Legal basis: Article 84 of the Contract Law of the People's Republic of China. If the debtor transfers all or part of the contractual obligations to a third party, it shall obtain the consent of the creditor.
