How long does it usually take to freeze and unfreeze bank accounts?
The bank card is frozen, which means it can't be used normally for the time being. If the bank card is frozen for different reasons, the thawing time is different:
1. If it is frozen due to three consecutive password errors, it will generally be thawed within 24 hours.
2. If the bank card is temporarily frozen due to loss or other reasons, it usually takes 5-7 working days to unfreeze.
3. If the bank card is frozen by the court, it can only be unfrozen if the case is closed.
4. If all accounts are frozen due to loans overdue and other reasons, you need to pay off the arrears and unfreeze them after the bank goes through the unfreezing procedures.
Bank cards will also be frozen under the following circumstances:
1. Abnormal transactions occurred in the bank card, such as payment for large transactions in different places, transfer of funds to suspected fraudulent accounts, abnormal account behaviors, etc. At this time, it was discovered by the bank background monitoring system. In order to protect the interests of customers from losses, banks sometimes temporarily stop paying and freeze accounts.
2. The People's Bank of China now requires all commercial banks to install anti-money laundering systems, and there is a special anti-money laundering bureau in the background to monitor and deal with the systems. If major money laundering suspects are found, the Anti-Money Laundering Bureau of the People's Bank of China will directly instruct commercial banks to temporarily freeze bank cards.
Does the court freeze personal accounts and every bank freezes them?
When the court freezes personal accounts, not every bank will be frozen, but if the court deems it necessary, it will freeze other bank cards under its name.
Article 242 of the Civil Procedure Law: The property inquired, frozen or deducted by the people's court shall not exceed the obligation of the person subjected to execution. There are two situations:
1. There is only one bank account, and if the balance of the deposit is insufficient to fulfill the obligations, all of them will be frozen. If the balance exceeds the subject matter of the lawsuit, it shall be frozen according to the amount of the subject matter of the lawsuit, and the remaining part shall not be frozen, and the defendant may trade.
2. If there are more than one bank account, it shall be frozen in order of the balance from large to small until the subject matter of litigation. If the total balance is insufficient, all accounts will be frozen. If the total balance exceeds the object of litigation, the object of litigation shall prevail, and the defendant may trade the remaining margin.
