1. loan contract: a contract in which the borrower borrows money from the lender, repays the loan at maturity and pays interest. (Article 196)
2. Special terms of loan contract between natural persons:
(1) The loan contract between natural persons is a practical contract.
Article 210 of People's Republic of China (PRC) Contract Law: The loan contract between natural persons shall come into effect when the lender provides the loan.
(2) The loan contract between natural persons can be paid or unpaid.
Article 211 of the Contract Law of People's Republic of China (PRC): If the loan contract between natural persons does not stipulate or clearly stipulate the payment of interest, it shall be deemed that no interest is paid. If the loan contract between natural persons stipulates the payment of interest, the loan interest rate shall not violate the relevant provisions of the state that limit the loan interest rate.
(3) The loan contract between natural persons is optional, and can be in written form, oral form or other forms.
Article 197 of People's Republic of China (PRC) Contract Law: A loan contract shall be in written form, unless otherwise agreed between natural persons.
