Legal analysis: Generally speaking, mutual consent is required. If the house purchased before marriage needs to be repaid with the same loan after marriage, the value-added part of the house and the part repaid with the same loan shall be owned by both husband and wife. During the marriage, one party with registered property rights should obtain the consent of the other party when selling the property. If one spouse arbitrarily disposes of the house jointly owned by * * * and * *, causing losses to the other spouse, and the other spouse requests compensation for the losses during the divorce, the people's court shall support it.

If one party sells the house jointly owned by husband and wife without the consent of the other party, the third party purchases it in good faith, pays a reasonable consideration and has registered the real estate, and the other party claims to take back the house, the people's court will not support it. If one spouse disposes of all the houses without authorization, causing losses to the other spouse, and the other spouse requests compensation for the losses during divorce, the people's court shall support it.
