Legal basis: Measures for the Registration of Houses
Article 48 If the legally registered mortgage of a house is under any of the following circumstances, the obligee shall apply for cancellation of mortgage registration: (1) The principal creditor's rights are extinguished; (2) The mortgage right has been realized; (3) The mortgagee waives the mortgage right; (4) Other circumstances stipulated by laws and regulations.
Article 49 To apply for cancellation of mortgage registration, the following materials shall be submitted: (1) an application for registration; (2) the identity certificate of the applicant; (3) Certificate of ownership of the house; (four) materials to prove the destruction of housing mortgages; (5) Other necessary materials.
