negotiate
Negotiation is the first choice, which saves time and effort.
2. Payment order request
There are certain conditions for the court to issue a payment order to the debtor:
1, requesting the debtor to pay money or securities;
2. The money or securities requested for payment have expired and the amount has been determined, and the facts and evidence on which the request is based are explained;
3. There is no other debt dispute between the creditor and the debtor;
4. The payment order can be served on the debtor.
Step 3 sue
If the other party disagrees after the payment order is issued, then you can only choose to sue.
Foreigners, stateless persons, foreign enterprises and organizations shall enjoy the same litigation rights and obligations as citizens, legal persons and other organizations in People's Republic of China (PRC) when bringing a lawsuit or responding to a lawsuit in a people's court. If a foreign court restricts the civil litigation rights of citizens, legal persons and other organizations in People's Republic of China (PRC) (China), the people's court in People's Republic of China (PRC) (China) shall apply the principle of reciprocity to the civil litigation rights of citizens, enterprises and organizations in that country.
What foreigners do in our country must also abide by our legal system. Lending money to foreigners at the beginning had certain legal risks, because if the debtor has returned to the nationality where the debtor is located, it will be even more troublesome for creditors to collect debts.
