The speculation of stocks and futures in partnership enterprises mainly involves value-added tax and income tax.

The "Implementation Measures for the Pilot Reform of Business Tax to VAT" (Caishui [20 1 6] No.36, annex1) and the Notes on Sales Services, Intangible Assets and Real Estate stipulate that the transfer of financial goods belongs to the taxable scope of VAT. The transfer of financial commodities refers to the business activities of transferring the ownership of financial commodities such as foreign exchange, securities and non-commodity futures. The transfer of other financial commodities includes the transfer of various asset management products such as funds, trusts and wealth management products and various financial derivatives.

Article 2 of the Notice of the Ministry of Finance, People's Republic of China (PRC) and State Taxation Administration of The People's Republic of China on the Income Tax of Partners in Partnership Enterprises (Caishui [2008] 159) stipulates that the partnership enterprises shall take each partner as the taxpayer. If the partners of a partnership are natural persons, they shall pay individual income tax; If the partners are legal persons or other organizations, they shall pay enterprise income tax.
