Legal basis: Article 18 of the Regulations on Supervision of Labor Security, the administrative department of labor security shall, according to the results of investigation and inspection, deal with the acts that violate the laws, regulations or rules of labor security as follows: (1) If the punishment should be given according to law, the administrative punishment decision shall be made according to law; (two) if the correction is not corrected, it shall be ordered to make corrections or make corresponding administrative decisions; (3) If the circumstances are minor and have been corrected, the case shall be dismissed. If it is found that illegal cases do not belong to labor security supervision matters, they shall be promptly transferred to relevant departments for handling; Anyone suspected of committing a crime shall be transferred to judicial organs according to law.
Article 12 of the Administrative Reconsideration Law of People's Republic of China (PRC) refuses to accept the specific administrative act of the working department of the local people's government at or above the county level. The applicant may choose to apply for administrative reconsideration to the people's government at the same level or the competent department at the next higher level. If they are dissatisfied with the specific administrative acts of the administrative organs or state security organs that implement vertical leadership, such as customs, finance, national tax and foreign exchange management, they shall apply to the competent department at the next higher level for administrative reconsideration.
