Measures for the Administration of China Citizens Going Abroad (Revised on 20 17)
Article 1 These Measures are formulated for the purpose of regulating travel agencies' activities of organizing China citizens to travel abroad and safeguarding the legitimate rights and interests of overseas tourists and overseas tour operators. Article 2 The destination countries of overseas tourism shall be proposed by the tourism administrative department of the State Council in conjunction with the relevant departments of the State Council, and announced by the tourism administrative department of the State Council after being approved by the State Council.

No unit or individual may organize China citizens to travel to countries other than the destination countries announced by the tourism administration department of the State Council; Organizing China citizens to travel to countries other than the destination countries announced by the tourism administrative department of the State Council for temporary special tourism involving sports activities and cultural activities must be approved by the tourism administrative department of the State Council. Article 3 A travel agency operating overseas tourism business shall meet the following conditions:

(1) Having obtained the qualification of international travel agency for 1 year;

(2) Having made remarkable achievements in operating inbound tourism business;

(3) There are no major illegal acts or major service quality problems during the operation period. Article 4 A travel agency applying for overseas tourism business shall apply to the tourism administrative departments of provinces, autonomous regions and municipalities directly under the Central Government. The tourism administrative departments of provinces, autonomous regions and municipalities directly under the Central Government shall, within 30 working days from the date of accepting the application, complete the examination and approval of the application according to the conditions stipulated in Article 3 of these Measures, and report it to the tourism administrative department of the State Council for approval after examination and approval; If it disagrees after examination, it shall notify the applicant in writing and explain the reasons.

The approval of travel agencies to engage in overseas tourism business by the tourism administrative department of the State Council shall conform to the requirements of tourism development planning and rational distribution.

Without the approval of the tourism administrative department of the State Council, no unit or individual may operate overseas tourism business without authorization or in disguised form by means of business, inspection and training. Article 5 The tourism administrative department of the State Council shall publish the list of travel agencies (hereinafter referred to as package tours) that have obtained overseas tourism business qualifications, and notify the relevant departments of the State Council. Article 6 The tourism administrative department of the State Council shall, according to the performance of national inbound tourism in the previous year, the increase of overseas tourist destinations and the development trend of overseas tourism, determine the total number of overseas tourists organized this year before the end of February each year, and issue them to the tourism administrative departments of provinces, autonomous regions and municipalities directly under the Central Government.

The tourism administrative departments of provinces, autonomous regions and municipalities directly under the Central Government shall, according to the inbound tourism performance, business ability and service quality of the travel agencies within their respective administrative areas in the previous year, and in accordance with the principles of fairness, justice and openness, verify the arrangement of the number of overseas tourists organized by the travel agencies this year before the end of March each year.

The tourism administrative department of the State Council shall supervise the arrangement of overseas tourists approved by the tourism administrative departments of provinces, autonomous regions and municipalities directly under the Central Government and the overseas travel organized by travel agencies. Article 7 The tourism administrative department of the State Council shall uniformly print the List of China Citizens Traveling Abroad (hereinafter referred to as the List). When arranging the number of overseas tourists this year, the number shall be distributed to the tourism administrative departments of provinces, autonomous regions and municipalities directly under the Central Government, and the tourism administrative departments of provinces, autonomous regions and municipalities directly under the Central Government shall distribute it to tour groups.

Packaged travel agencies shall arrange overseas travel teams according to the approved number of overseas tourists and fill in the list. Tourists and tour guides who leave the country for the first time or again shall fill in the list, and no additional personnel shall be added to the list after examination. Article 8 The list is made in quadruplicate, which is divided into: special seal for entry-exit frontier inspection, special seal for entry-exit frontier inspection, special seal for inspection by tourism administration department and special seal for travel agency.

The travel agency shall submit the list to the relevant departments for inspection and retention in accordance with relevant regulations when the travel team leaves or enters the country and after the travel team enters the country.

Foreign exchange for individual tourists traveling abroad shall be handled in accordance with relevant state regulations. Article 9 A tourist with a valid ordinary passport can go directly to the package tour agency to go through the formalities of traveling abroad. Those who do not have a valid ordinary passport shall apply for a passport in accordance with the relevant provisions of the Law of People's Republic of China (PRC) on the Administration of Exit and Entry of Citizens of China before going through the formalities for going abroad.

Travel agencies should go through exit formalities such as visas for tourists. Article 10 A travel agency shall arrange a full-time tour leader for the tourism team.

The tour leader shall abide by these measures and the relevant provisions of the tourism administrative department of the State Council. Eleventh tourism teams should enter and leave the country from the open ports as a whole.

When entering or leaving the country, the tourism team shall accept the examination of passports, visas and lists at the frontier inspection station. With the approval of the relevant departments in the State Council, the tourism team can go to the destination country to apply for visa or visa exemption according to the relevant regulations of that country.

If the tourism team has decided to enter the country by group before leaving the country, the group agency shall file with the entry-exit frontier inspection station or the provincial public security frontier defense department in advance.

If the travel team really needs to enter the country after leaving the country due to force majeure or other special reasons, the tour leader shall promptly notify the travel agency, and the travel agency shall immediately file with the relevant entry-exit frontier inspection station or the provincial public security frontier defense department. Twelfth tour groups should safeguard the legitimate rights and interests of tourists.

The overseas travel service information provided by tour groups to tourists must be true and reliable, and no false propaganda shall be carried out, and the quotation shall not be lower than the cost.
