The declaration mentioned in these Provisions refers to the written statement made by the inbound and outbound passengers to the customs in accordance with the law on the actual situation of their inbound and outbound luggage and articles in order to fulfill their obligations stipulated by the customs laws and regulations of People's Republic of China (PRC) and China.
Article 3 Inbound and outbound passengers who have gone through the customs declaration formalities according to the regulations shall first submit the People's Republic of China (PRC) Entry and Exit Passenger Baggage Declaration Form and the People's Republic of China (PRC) Customs Declaration Form or other declaration documents stipulated by the customs, and truthfully declare their inbound and outbound luggage.
If inbound and outbound passengers declare their luggage and articles in other ways or at other times and places, the customs shall not consider them as declarations.
Article 4 The declaration formalities shall be handled by the passengers themselves, and the customs shall be responsible for it. Entrusted by others, the declaration documents shall be signed by the passenger himself. An agent entrusted to handle the declaration formalities shall abide by the provisions of these Provisions on his client and bear corresponding legal responsibilities.
Article 5 When declaring to the customs, passengers should take the initiative to present valid inbound and outbound travel documents and identity documents, and submit certificates, commercial documents and other necessary documents issued by the relevant authorities in People's Republic of China (PRC) and China to allow the entry and exit of relevant articles.
Article 6 A copy of the customs declaration form or special declaration form that has been handled by the customs and signed by the passenger shall be properly kept by the passenger within the period of validity or customs supervision, and shall be presented to the customs voluntarily when applying for baggage claim, transportation alone or purchase of duty-free foreign exchange goods or other relevant formalities.
Article 7 In places under customs supervision, the customs shall set up a special declaration desk in the passage for passengers to go through the formalities of declaration of inbound and outbound articles.
In the places under customs supervision approved by People's Republic of China (PRC) and the General Administration of Customs, the Customs shall set up "declaration" channels (also known as "red channels") and "non-declaration" channels (also known as "green channels") for inbound and outbound passengers to choose according to these provisions.
Article 8 The following inbound passengers shall declare to the Customs and submit declaration documents to the Customs for entry formalities:
Carrying the second, third and fourth categories of articles (except tobacco and alcohol within the duty-free limit) that need to be taxed or exempted by the customs in the Classification Table of Passengers' Inbound and Outbound Luggage;
Non-resident passengers and resident passengers with re-entry visas carry cameras, portable tape recorders, small cameras, portable video cameras and portable word processors for their own use;
Carrying more than 6,000 yuan in cash, or more than 50 grams of gold, silver and its products;
Non-resident passengers carry foreign currency cash equivalent to more than 5,000 US dollars;
Resident passengers carry foreign currency cash equivalent to more than $65,438+$0,000;
Carrying goods, samples and articles beyond the scope of passengers' personal luggage;
Carrying animals and plants, their products and other articles that need to go through the formalities of inspection and release as stipulated by China quarantine.
Article 9 The following outbound passengers shall declare to the customs, and submit declaration documents to the customs to go through the exit formalities of articles:
Carrying cameras, portable tape recorders, small cameras, portable video cameras, portable word processors and other articles for personal use in travel;
Taking out the original articles that should be taken out of the country or the temporary duty-free articles that should be brought into the country without completing the customs formalities;
Carrying foreign currency, gold and silver and their products without obtaining the relevant exit permit to reach or exceed the number declared for entry this time;
Carrying more than 6,000 yuan in cash;
Those who carry cultural relics;
Carrying goods and samples;
Carrying articles out of the country beyond the limit, limit or other restrictions stipulated by the customs;
Carrying animals and plants, their products and other articles that need to go through the formalities of inspection and release as stipulated by China quarantine.
Article 10 Passengers listed in Articles 8 and 9 of these Provisions shall choose the "declaration" channel for customs clearance at the customs supervision place where the dual-channel system is implemented.
Article 11 Passengers who do not know the customs regulations or how to choose the channel should choose the "declaration" channel and go through the declaration formalities with the customs.
Article 12 Passengers other than those listed in Articles 8, 9 and 11 of these Provisions may not go through the customs declaration formalities. Where the customs implements the dual-channel system, you can choose the "declaration-free" channel to enter and leave the country.
Article 13 Entry-exit non-resident passengers who hold diplomatic and courtesy visas granted by the competent authorities of People's Republic of China (PRC) and the government of China, as well as other passengers who are exempted from inspection by the customs, should take the initiative to show their passports (or other valid entry-exit certificates) and identity documents to the customs at the time of customs clearance.
Article 14 When entering or leaving the country, passengers shall abide by these Provisions and other supplementary provisions formulated and issued by the relevant customs and the General Administration of Customs authorized by People's Republic of China (PRC) for the implementation of these Provisions.
Article 15 If a passenger fails to declare his articles and goods to the Customs as required, and the passengers listed in Articles 8, 9 and 11 of these Provisions fail to choose the customs clearance channels as required, the Customs shall deal with them according to the relevant provisions of the Customs Law of People's Republic of China (PRC) and the Detailed Rules for the Implementation of Administrative Punishment in People's Republic of China (PRC).
Article 16 These Provisions shall be implemented as of 1996 1 month 1 day.
