Moreover, in recent years, with the changes in the economic situation at home and abroad, illegal fund payment and settlement business, illegal foreign exchange trading and other criminal activities of underground banks have become more and more rampant, and there have been more and more criminal cases of underground banks. They not only involve crimes in the economic field, but also become ways for criminal activities such as telecom fraud and online gambling to transfer stolen money, become money laundering tools and criminals of corruption and terrorist activities, and seriously endanger national financial security and social stability.
Illegal trading of foreign exchange mainly includes reselling foreign exchange, unauthorized trading of foreign exchange, abnormal trading of foreign exchange, etc. For those who illegally buy and sell foreign exchange, the foreign exchange bureau will issue a warning, forcibly collect and detain the income, and impose a fine not exceeding 30% of the illegal amount. If the circumstances are serious, criminal responsibility shall be investigated according to law.
If the illegal operation of foreign exchange constitutes a crime, according to Article 225 of the Criminal Law, if the circumstances are serious, he shall be sentenced to fixed-term imprisonment of not more than five years, if the circumstances are particularly serious, he shall be sentenced to fixed-term imprisonment of not less than five years, and shall also be fined not less than 1 times but not more than five times the illegal income, or his property shall be confiscated. If a company commits a crime, it shall be sentenced to fixed-term imprisonment of more than five years or confiscation of property in accordance with Article 23 1 of the Criminal Law.
