Article 2 The term "science and technology industry in institutions of higher learning" as mentioned in these Provisions refers to the science and technology industry in which institutions of higher learning, according to their comprehensive advantages in specialty and science and technology, redevelop international and domestic advanced scientific and technological achievements (including introduction, digestion, absorption and software), form certain production indicators, and gradually spread to the society. Article 3 Science and technology enterprises in colleges and universities are economic entities and an important part of school-run industries. Assets (including fixed assets, working capital, etc. ), the technology and intellectual property rights of science and technology industries founded by colleges and universities are state-owned assets. Article 4 This Municipality encourages universities to set up science and technology industries, and the Municipal Planning Commission, Economic Commission, Science and Technology Commission, Foreign Economic and Trade Commission, Municipal Finance Bureau, Taxation Bureau, Labor Bureau, Personnel Bureau, Industry and Commerce Bureau, Customs, Banks and other departments implement preferential policies for science and technology industries in universities. Article 5 If the performance, quality and level of the products produced by the science and technology industry in colleges and universities in this city reach or exceed similar products abroad, and reach certain production indicators, which can basically meet domestic demand, the relevant municipal departments shall report to the competent department of the State Council and the State General Administration of Customs for approval and include them in the catalogue of restricted imports. Article 6 In developing science and technology industry, institutions of higher learning must proceed from reality, make overall plans, and concentrate on running one or several key enterprises according to the needs of international and domestic markets and their own academic advantages. Colleges and universities should gradually form 1 2 top products with good market prospects, high technology maturity and certain economies of scale. Chapter II Organizational Leadership and Management System Article 7 Shanghai University Science and Technology Industry Coordination Group (hereinafter referred to as the Municipal Coordination Group) shall be established. The Municipal Coordination Group is presided over by the deputy mayor in charge, and is composed of the leaders of the Municipal Planning Commission, the Municipal Economic Commission, the Municipal Science and Technology Commission, the Municipal Foreign Economic and Trade Commission, the Municipal Education and Sports Office, the Municipal Personnel Bureau, the Municipal Finance Bureau, the Municipal Higher Education Bureau, the People's Bank of China Branch, some university presidents and relevant experts. Its responsibilities are: to formulate the development plans and policies of science and technology industry in colleges and universities in this city; Coordinate the work of relevant committees, offices, bureaus and other units with the science and technology industry in colleges and universities; Determine the school-run science and technology industries and projects; Preside over the confirmation and approval of payment items; Organize the exchange of work experience in science and technology industry; Review and supervise the use of funds for science and technology industry in colleges and universities; Responsible for rewards and punishments. Article 8 There is an office under the Coordination Group of Science and Technology Industry in the city's colleges and universities (hereinafter referred to as the Office of the Coordination Group), which is composed of relevant departments of the municipal government and a number of full-time staff, and is subordinate to the Education and Health Office of the municipal government, and is specifically responsible for the daily work. Article 9 Institutions of higher learning shall, in accordance with the provisions of the document of the State Education Commission (No.01990), set up centralized management institutions and subordinate institutions of school-run industries to conduct unified management of school-run scientific and technological enterprises (including other industries). Article 10 Science and technology enterprises in colleges and universities are relatively independent economic entities with legal personality. According to the different requirements of enterprise and enterprise operation mechanism, colleges and universities implement the mode of "one school and two management", and implement enterprise management in personnel, finance and distribution of science and technology enterprises, so that they can operate independently, be responsible for their own profits and losses, develop themselves and be self-disciplined. Chapter III Preferential Policies and Supporting Measures Article 12 All scientific and technological enterprises in colleges and universities that meet Article 2 of these Provisions may enjoy the following preferential policies:

Colleges and universities that meet the standards of high-tech industries identified by the Municipal Coordination Group can enjoy preferential policies such as import and export business, capital and credit, personnel entry and exit, personnel labor wages, etc. in caohejing Emerging Technology Development Zone.
2, export, import substitution, supporting agriculture and in line with the national key development direction of the project can be included in the city's development plan.

All eligible projects can be included in the technical transformation plan, new product development plan and digestion and absorption introduction project plan of the Municipal Economic Commission. On the implementation of better projects and products, the Municipal Economic Commission can organize identification. Thirteenth approved university science and technology industry projects are all included in the national fixed assets investment scale. The school's investment in science and technology industry, including fixed assets, can be transferred according to the relevant provisions of the state. Article 14 The foreign exchange generated by the science and technology industry in colleges and universities shall be fully reserved for enterprises within five years. Universities that earn foreign exchange through export can set up foreign exchange quota accounts to support the settlement of foreign exchange by university enterprises. All university science and technology enterprises and science and technology enterprise groups registered in Pudong New Area or caohejing Emerging Technology Development Zone can enjoy the dual preferential policies of universities and Pudong New Area or caohejing Emerging Technology Development Zone. Science and technology enterprises established in Pudong may be granted the right to import and export themselves with the approval of the Municipal Foreign Economic and Trade Commission. Due to the export needs of scientific and technological products, the directly related personnel who have signed the Sino-foreign cooperation agreement and engaged in foreign operation, installation, maintenance and after-sales service shall be reviewed, and their overseas approval shall be settled in time according to the relevant provisions of the State Council, and foreign exchange expenses may be paid from the foreign exchange retained by the enterprise. Article 15 The profits of the university's science and technology industry and the dividends that the university receives from the joint venture shall be exempted from income tax. Generally, not less than 35% will be included in the school fund, not less than 30% will be included in the enterprise development fund, and the rest will be independently distributed by science and technology enterprises according to regulations. For newly established high-tech industries or high-tech industries with large investment in major technological transformation, the school has the right to appropriately adjust the distribution ratio to support the development of science and technology industries.
