Chapter I General Provisions
Article 1 These Provisions are formulated in order to further implement the decisions of the Central Committee of the Communist Party of China and the State Council on further strengthening the work of talents, implement the main strategy of "invigorating the city through science and education", implement the strategic action plan of strengthening the city through talents in Shanghai, and continuously optimize the working and entrepreneurial environment of overseas students in Shanghai.
Article 2 These Provisions shall apply to overseas students who come to Shanghai to work and start businesses, including those who have entered foreign countries and those who have studied abroad from Hong Kong, Macao and Taiwan.
Article 3 The Municipal Personnel Bureau is the competent department for overseas students to work and start businesses in Shanghai. Responsible for formulating and organizing the implementation of the policies and plans for introducing overseas students in this Municipality, comprehensively analyzing the information of overseas students, and evaluating the related work benefits.
Municipal Science and Technology Commission, Municipal Education Commission, Municipal Public Security Bureau, Municipal Administration for Industry and Commerce, Municipal Foreign Investment Commission, Municipal Bureau of Quality and Technical Supervision, Municipal Finance Bureau, Municipal Local Taxation Bureau, Municipal Labor and Social Security Bureau, Municipal Information Commission, Municipal Medical Insurance Bureau, Municipal Population and Family Planning Commission, Shanghai Customs, Shanghai Branch of China People's Bank, and Shanghai Branch of State Administration of Foreign Exchange shall, according to their respective functions and duties, do a good job in encouraging overseas students to work and start businesses in Shanghai.
Article 4 The relevant government departments, overseas students' pioneer parks, overseas students' friendship associations and overseas students' employing units shall strengthen the education of ideological and political morality construction for overseas students, so that they can consciously abide by laws, regulations, rules and social ethics. At the same time, we should care about the work and life of overseas students and provide convenience for overseas students to work and start businesses in Shanghai.
Article 5 The "Shanghai Joint Conference on Coordinating the Work of Overseas Students" is composed of relevant units in this Municipality, mainly to solve major problems in the work of overseas students. The daily work of the joint meeting shall be the responsibility of the Municipal Personnel Bureau.
Chapter II Qualifications of International Students and Ways of Serving the City
Article 6 The overseas students mentioned in these Provisions refer to:
(1) Persons who have studied abroad (at their own expense) and obtained a bachelor's degree or above;
(2) Visiting scholars or trainees who have obtained bachelor's degree or above or intermediate professional and technical post qualifications in China, and have studied or researched in foreign institutions of higher learning for more than 1 year (inclusive) and achieved certain results.
Article 7 This Municipality focuses on introducing high-level overseas students urgently needed in strategic industries and key projects. The high-level overseas students mentioned in these Provisions shall meet the following conditions in addition to Article 6:
(1) He enjoys a certain reputation in the international academic and technical circles, is a pioneer or founder in a certain field, or is a famous scientist who has made great contributions to the development of a certain field;
(2) Experts and scholars who are equivalent to associate professors and associate researchers in famous foreign universities and research institutes;
(3) Management experts who hold senior management positions in world-renowned enterprises, or senior technical positions in well-known multinational companies and financial institutions, and senior technical positions in well-known lawyer (accounting and consulting) firms, who are familiar with relevant businesses and international rules and have rich practical experience;
(four) experts and scholars who hold senior management positions in government agencies, intergovernmental international organizations and famous foreign non-governmental organizations;
(5) With deep academic attainments, he has made great contributions to the development of a certain profession or field, published influential academic papers in internationally renowned academic journals, or won academic awards with international influence, and his achievements are at the forefront of the industry or field, and he is recognized as an expert and scholar in the industry;
(six) experts, scholars and technicians who have presided over large-scale international scientific research or engineering projects and have rich experience in scientific research and engineering technology;
(seven) professional and technical personnel with independent intellectual property rights or major technological inventions, patents and other proprietary technologies;
(eight) special talents with special expertise and in urgent need of this Municipality.
Article 8 Overseas students are encouraged to serve the economic and social development of this Municipality in various ways in accordance with relevant laws, regulations and rules, as well as the relevant provisions of the State and this Municipality:
(a) as a national civil servant, state organ consultant or consultant, technical expert;
(two) the establishment of high-tech enterprises in the form of technology shares or investment;
(three) as the legal representative of state-owned enterprises;
(four) in schools, scientific research institutes, medical institutions, cultural and art troupes, news media, financial institutions, key (open) laboratories, engineering technology research centers and other enterprises and institutions employed or part-time professional and technical positions, senior management positions, consultants or honorary positions;
(five) investment in education, medical institutions or architectural design, lawyers, accounting, consulting and other service institutions;
(six) the use of advanced science and technology, equipment and funds and other conditions, and institutions of higher learning, research institutes, various enterprises and other cooperative research or establish cooperative research and development bases;
(seven) as a senior management or technical position of major projects and key projects;
(eight) to give lectures or carry out academic, cultural and artistic exchanges in this city;
(9) Conducting research and development activities of entrusted scientific research projects abroad, or entrusting overseas scientific research projects to relevant research units and groups in this Municipality for research and development;
(ten) relying on overseas scientific research, education and training institutions, cooperating with relevant units or accepting entrustment to train talents for employers;
(11) Intermediary institutions registered in this Municipality provide intermediary services for the introduction of foreign capital, technologies and projects in this Municipality, contact foreign experts to hold various academic and technical exchange activities in this Municipality, contact foreign academic and technical groups to carry out international scientific and technological and economic exchanges and cooperation, and engage in intermediary services such as the promotion and marketing of this Municipality's products in the international market abroad;
(twelve) to apply for work in the overseas institutions of this Municipality;
(thirteen) to serve the city in other ways.
Chapter III Establishment of Enterprises and Other Economic Entities

Article 10 The Municipal Personnel Bureau may first accept the qualification confirmation that overseas students entrust domestic relatives and friends to apply for establishing overseas students' enterprises to enjoy preferential policies, and then the relevant departments shall go through relevant procedures to facilitate overseas students to invest and start businesses in Shanghai.

Thirteenth overseas students' pioneer parks provide convenient services in enterprise registration, land use, taxation, commodity inspection, import and export agency, commerce, public utilities, labor and personnel. , simplify procedures, reduce links, and give preferential treatment to overseas students registered in the park in terms of venue rent, financial support and information services. At the same time, assist overseas students to declare various government-funded projects in this city according to procedures.
Fourteenth governments at all levels should increase their support for overseas students' pioneer parks, actively support the establishment of overseas students' pioneer parks, and care about the construction and development of overseas students' pioneer parks. It is necessary to establish an evaluation mechanism for high-tech projects in overseas students' pioneer parks, select enterprises with high-tech content to settle in the pioneer parks, and truly become a base for overseas students to incubate high-tech enterprises and transform innovative scientific research achievements.
Fifteenth Municipal Personnel Bureau shall, jointly with the district and county governments and relevant departments, strengthen the guidance, support and management of overseas students' pioneer parks. The Municipal Personnel Bureau shall regularly inspect and evaluate the Overseas Students Pioneer Park.
Chapter IV Related Treatment
Sixteenth overseas students who come to work or start a business in this Municipality may apply for the "Shanghai Residence Permit" in accordance with the relevant provisions of this Municipality. Among them, students studying abroad can apply for the "Shanghai Residence Permit" B certificate.
Article 17 This Municipality encourages all district and county governments to set up classes for children of overseas students, and care about the enrollment and further studies of children of overseas students. Children of overseas students with valid Shanghai residence permit B enjoy the same treatment as citizens in preschool education and compulsory education. Those who have lived abroad for more than 5 years and participated in the junior high school entrance examination in this city during the domestic language adaptation period (3 years) may appropriately reduce the admission score. Children of overseas students with Shanghai residence permit B who have obtained the high school diploma in this city can apply for the municipal colleges and universities in this city.
Article 18 If a foreign student who holds the B certificate of Shanghai Residence Permit needs to enter and leave the country for multiple times, the public security department of this Municipality shall handle multiple entry and exit visa procedures according to the validity period of the B certificate of Shanghai Residence Permit. Units that work for international students should assist international students in handling relevant procedures.
Article 19. Students studying abroad may be exempted from other employment certificates after obtaining the Shanghai residence permit B certificate.

Article 21 Overseas high-level overseas students who come to Shanghai to settle down, work or start a business, themselves and their spouses, accompanying children or their spouses are in China, and their children under the age of 16 or studying in ordinary middle schools may apply to the Municipal Personnel Bureau for permanent residence or Shanghai residence permit in accordance with the relevant provisions of this Municipality.
Article 22 This Municipality shall set up special funds to raise funds through various channels for the funding and related subsidies for high-level overseas students to start businesses, work and give short-term lectures in Shanghai. Measures for the collection, use and management of special funds shall be formulated by the Municipal Personnel Bureau jointly with the Municipal Finance Bureau, the Municipal Local Taxation Bureau, the Municipal Science and Technology Commission and the Municipal Information Commission. The raising of funds shall be handled in accordance with the relevant provisions of the state.
District and county governments can set up necessary special funds to support high-level overseas students to start businesses and find jobs in Shanghai.
Twenty-third units in this city should be concerned about the employment of spouses of high-level overseas students, and priority should be given under the same conditions.
Article 24 This Municipality encourages all kinds of financial institutions, domestic and foreign venture capital funds and private capital to set up venture capital funds for overseas students in accordance with the relevant provisions of the State and this Municipality to provide financial support for overseas students to start their own businesses.
Twenty-fifth overseas students engaged in recognized high-tech achievements transformation projects in Shanghai can enjoy additional deduction when calculating the personal income tax payable.
Twenty-sixth overseas students can apply for the position of national civil servant in this Municipality in accordance with relevant laws, regulations and provisions. The Municipal Personnel Bureau may, according to the characteristics of overseas students and the needs of government agencies, organize qualified overseas students to participate in the national civil service recruitment examination, and employ qualified overseas students as national civil servants in accordance with the principles of openness, fairness and impartiality.
Twenty-seventh overseas students working or starting a business in Shanghai, after obtaining the "Shanghai Residence Permit" B certificate, can apply for social insurance in accordance with the provisions of this Municipality, and enjoy the corresponding treatment.
Article 28 This Municipality encourages qualified hospitals to cooperate with domestic and foreign insurance companies to develop commercial medical insurance, so as to facilitate overseas students to seek medical treatment in Shanghai.

Article 33 If overseas students need to import scientific and educational supplies from abroad because of their urgent need for scientific research and teaching in Shanghai, their units shall apply to the customs, and the customs shall go through the formalities of tax reduction and exemption in accordance with relevant state regulations. If you need to pay for foreign imports, you can go to the designated foreign exchange bank to purchase foreign exchange with import contracts, invoices, import payment declarations and other materials.
Article 34. Overseas students who come to Shanghai to work or settle down may apply for importing articles for their own use in work and life with the certificate issued by the Municipal Personnel Bureau, and the customs will release them duty-free, except for articles listed and taxed as stipulated by the state.
Article 35 Within the industrial scope permitted and encouraged by the State and this Municipality, overseas students may use technology patents and scientific and technological achievements to come to Shanghai for technology transfer, technology contracting, technology shareholding, etc. , you can also start your own business or run joint ventures with enterprises in this city, or you can invest in Shanghai in the name of individuals or overseas registered companies. The registered capital of overseas students' enterprises can implement the minimum standards for registering similar enterprises.
Thirty-sixth overseas students who have made outstanding contributions to this Municipality shall be rewarded as appropriate.
Thirty-seventh to open up channels for overseas students to introduce overseas projects, the beneficiary units can give a certain proportion of remuneration.
Chapter V Supplementary Provisions
Article 38 These Provisions shall come into force on June 6+1October 6+1October 6, 2006.
