Chapter 8 of the Implementation Rules of the Measures for the Administration of Verification and Write-off of Export Proceeds: Automatic Verification of Export Proceeds

Article 51 For export units that meet the following conditions, the foreign exchange bureau shall determine their automatic verification qualifications on an annual basis:

(1) The balance of payments declaration rate is 100% .

(2) The assessment level of the verification and write-off of foreign exchange collection from exports last year was "Honorable Enterprise for Foreign Exchange Collection from Exports".

(3) There has been no violation of foreign exchange management regulations in the past two years.

(4) Other conditions specified by the foreign exchange bureau.

Article 52: When reviewing the automatic verification qualification of an export unit, the foreign exchange bureau shall fill in the "Export Collection Automatic Verification Qualification Form" (Annex 1 [omitted]) and report it to each level. . After approval by the State Administration of Foreign Exchange, the Foreign Exchange Administration shall promptly issue a "Notice of Confirmation of Automatic Verification Qualification" (Annex 2 [omitted]) to the export unit.

The export unit must sign and confirm on the receipt of the "Notice of Confirmation of Qualification for Automatic Verification" and promise to fulfill the prescribed obligations and assume relevant responsibilities before the foreign exchange bureau can implement automatic verification management on it.

Article 53: Each branch of the foreign exchange bureau shall promptly publish to the public the list of export units that implement automatic verification and cancellation management (hereinafter referred to as "automatic verification and cancellation units"), and send a copy to the local commerce, taxation, and customs and other relevant departments.

Article 54: Automatic verification units may apply to the foreign exchange bureau for the verification forms required for half-year exports at one time, and use the verification forms in accordance with relevant regulations.

Article 55: The automatic write-off unit shall recover the export payment in full and in a timely manner, and receive a special write-off coupon in accordance with relevant regulations.

Article 56 If any of the following circumstances occurs, the automatic write-off unit shall handle the write-off reporting procedures in accordance with the provisions of Chapter 6 of these Implementation Rules, and the foreign exchange bureau shall follow the provisions of Chapter 7 of these Implementation Rules Handle write-off procedures for them:

(1) Export business that cannot collect the full amount of foreign exchange as required.

(2) Export tax refund or other related procedures need to be processed within 90 days after the goods are declared for export and the foreign exchange has been collected.

(3) Exporting through trade without collecting foreign exchange or partially collecting foreign exchange.

(4) There is no need to declare foreign-related income when collecting foreign exchange after export.

In the second case, after the automatic verification unit reports to the foreign exchange bureau, the foreign exchange bureau shall adjust the date of export foreign exchange receivable accordingly in the "export foreign exchange collection verification and reporting system".

Article 57 Except for the circumstances specified in Article 56 of these Implementing Rules, automatic write-off units do not need to report write-off to the foreign exchange bureau, nor do they need to go to the foreign exchange bureau to go through the write-off procedures. However, The customs declaration form for verification should be submitted online, and the foreign exchange bureau will automatically write off the export declaration data and bank foreign exchange collection data in chronological order on a monthly basis through the "Export Foreign Exchange Collection Verification and Reporting System".

Article 58: Automatic verification units are not required to handle export tax refund procedures with the tax refund form of the verification form. The tax department shall submit the tax refund to the foreign exchange bureau on a monthly basis based on the electronic data received from the "China Electronic Port" data center and the foreign exchange bureau. Use the written-off list provided by the tax department to handle tax refund procedures.

Article 59: Automatic write-off units’ write-off business such as port filing, export customs declaration, forward exchange collection filing, balance write-off, refund of foreign exchange, and balance review shall be handled in accordance with relevant regulations.

Article 60: After the foreign exchange bureau handles the verification procedures for automatic verification units on a monthly basis, if its verification rate of export foreign exchange receipts does not reach the prescribed ratio, the foreign exchange bureau shall promptly issue an early warning notice to it.

Article 61 If the automatic verification unit has received three consecutive early warnings and the verification rate of export foreign exchange receipts has not reached the prescribed ratio, or if it no longer meets the conditions listed in Article 51, the foreign exchange bureau Its automatic write-off qualification can be revoked, and its automatic write-off qualification will no longer be assessed in the next year.

Article 62: For an automatic verification unit that has had its automatic verification qualification revoked, the foreign exchange bureau shall issue a "Notice of Cancellation of Automatic Verification Qualification" (Annex 3 [omitted]) to it and report to it. The State Administration of Foreign Exchange shall file it with the State Administration of Foreign Exchange and send a copy to the local commerce, taxation, customs and other relevant departments.

Article 63: After an automatic verification unit is revoked by the foreign exchange bureau of automatic verification qualifications, it shall handle the verification reporting procedures in accordance with Chapter 6 of these Implementation Rules, and the Foreign Exchange Bureau shall follow Chapter 7 of these Implementation Rules. The chapter stipulates that the write-off procedures should be carried out for it.

Article 64: Automatic verification units shall properly keep all original verification certificates of export foreign exchange receipts in accordance with relevant regulations.
