Your request for instructions on issues related to the settlement of foreign exchange funds for the purchase of domestic commercial housing by overseas natural persons (No.83 [2007] of Shanghai Huifa) has been received. The answer is as follows:

1. Overseas Chinese who purchase domestic commercial housing shall provide relevant documents in accordance with the Notice of the General Department of the State Administration of Foreign Exchange on Issuing the Operating Rules for Foreign Exchange Business under Capital Account Real Estate (Bank Edition and Foreign Exchange Bureau Edition) (Hui Zongfa [2007] No.83).

Two, both husband and wife * * * with the purchase of domestic commercial housing, one of which is a domestic individual, the other is an overseas individual, Hong Kong, Macao and Taiwan residents or overseas Chinese, shall be handled in accordance with the relevant provisions of overseas individuals, Hong Kong, Macao and Taiwan residents or overseas Chinese to buy domestic commercial housing.
