According to legal provisions, buying and selling bank cards is an illegal and criminal act.

According to Article 28 of Chapter 5 of the "Bank Card Business Management Measures" promulgated by the People's Bank of China: When applying for a bank card, an individual must provide the card-issuing bank with his or her valid identity document specified by the public security department. After the card-issuing bank passes the review, a registered account will be opened for the cardholder. The bank card and its account can only be used by the cardholder approved by the card-issuing bank, and may not be rented or lent.

The "Amendment (V) of the Criminal Law of the People's Republic of China and the People's Republic of China" clearly stipulates that those who illegally hold other people's credit cards in large quantities, sell, buy, or provide counterfeit credit cards to others shall be punished with three to fixed-term imprisonment of not less than 10 years and not more than 10 years of fixed-term imprisonment, and to a fine of not less than 10,000 yuan but not more than 100,000 yuan, or a fine of not less than 10,000 yuan but not more than 100,000 yuan. If the amount is huge or there are other serious circumstances, the sentence is to be not less than three years but not more than 10 years of fixed-term imprisonment, and a fine of not less than 20,000 yuan but not more than 200,000 yuan. A fine of less than RMB 10,000.

After bank cards are sold by criminals, they are mainly used to transfer and withdraw funds for downstream crimes such as telecommunications fraud, counterfeit card theft, money laundering, and bribery.

People whose names are used to open cards will suffer financial losses and the risk of credit limit reduction, and the vision of judicial cases will also be seriously disrupted.

The illegal buying and selling of bank cards has become an important driver of the continued high incidence of downstream crimes such as telecommunications fraud and counterfeit card theft.
