These regulations are not applicable to the production and import of natural gas, liquefied petroleum gas and dimethyl ether, the pipeline transportation of natural gas outside the city gate, the industrial production using gas as raw materials, and the production and use of biogas and straw gas.
The term "gas" as mentioned in these Regulations refers to the gas fuel that is used as fuel and meets certain requirements, including natural gas (including coalbed methane and shale gas), liquefied petroleum gas, artificial gas and dimethyl ether for town gas. Article 3 Urban gas management adheres to the principles of overall planning, ensuring safety, ensuring supply, standardizing services, saving energy and being efficient, and paying equal attention to construction and management. Article 4 The people's governments at or above the county level shall strengthen their leadership over gas work, incorporate gas work into the national economic and social development plan, and establish a gas management coordination mechanism with the participation of relevant departments. Article 5 The competent department of housing and urban construction of the provincial people's government is responsible for the management of urban gas in this province. The departments in charge of gas management of the people's governments of cities, prefectures and counties are responsible for the management of urban gas within their respective administrative areas.
The department in charge of gas vehicle filling stations of the provincial people's government is responsible for the management of gas vehicle filling stations in this province, and the department in charge of gas vehicle filling stations of the people's governments of cities, prefectures and counties is responsible for the management within their respective administrative areas.
Other relevant departments of the people's governments at or above the county level shall, in accordance with the provisions of these regulations and other relevant laws and regulations, be responsible for gas management within their respective functions and duties. Sixth gas management departments should use information technology to improve the safety supervision ability of the gas industry; Encourage and support gas operators to use big data and other information technologies to improve production, operation and service levels. Seventh people's governments at or above the county level shall increase investment in the construction of gas facilities, encourage and support all kinds of capital to participate in the unified planning of gas infrastructure investment and construction. Chapter II Planning and Construction Article 8 The gas management department of the people's government at or above the county level shall, jointly with relevant departments, formulate the development plan of urban gas in its administrative area, organize its implementation after being approved by the people's government at the same level, and report it to the gas management department of the people's government at the next higher level for the record. Ninth gas facilities construction projects shall conform to the urban and rural planning and urban gas development planning.
For pipeline gas city gate station, storage and distribution station, bottled gas storage and distribution station, gas storage station, gas filling station, gas vehicle filling station and other important gas facilities construction projects, the examination and approval unit shall solicit the opinions of relevant departments before the project is established, and examine and approve in strict accordance with the basic construction procedures.
Small gas facilities, such as gas pipelines, gas bottle stations, bottled gas distribution outlets, etc. In residential areas, it must be approved by the gas management department of the people's government at or above the county level before implementation. Tenth new construction, expansion and reconstruction projects in the urban gas development planning area need to support the construction of gas facilities, and should be synchronized with the main project of the construction project planning, synchronous design, synchronous construction, synchronous acceptance and synchronous transfer of construction data files.
The gas management departments of the people's governments of cities, prefectures and counties shall, according to the requirements of urban gas development planning and safety production, organize a review of the preliminary design of construction projects such as gas filling stations that meet the standards of major hazard sources. Eleventh urban gas development planning area of new residential town gas engineering installation fees should be included in the cost of residential construction, any enterprise shall not charge residents in any form.
Because there is no ventilation condition, the installation fee of city gas project is not included in the housing construction cost, which shall be agreed in the housing sales contract; If it is not stipulated in the house sales contract, it shall not be charged to the resident users.
If the residential building has been built to supplement the pipeline gas facilities, the installation fee of the urban gas project shall be charged to the residents by the pipeline gas operators in accordance with the contract, but it shall not be higher than the charging standard formulated by the price department of the provincial people's government.
Non-resident users of the city gas engineering installation fees, in accordance with the relevant departments of the provincial people's government to determine the project cost quota valuation, by the pipeline gas operators in accordance with the contract to collect non-resident users.
Gas metering devices installed by gas operators shall be verified by qualified metrological verification institutions and affixed with verification marks. Users can refuse to install gas metering devices without certification marks. Chapter III Operation and Service Article 12 The pipeline gas shall be franchised, and the people's government at the county level shall select the operators through bidding according to the urban gas development plan, and sign the pipeline gas franchise agreement. Pipeline gas franchise activities, in accordance with the "Regulations" of Guizhou province municipal public utilities franchise management and the relevant provisions of the state. Thirteenth individuals are prohibited from engaging in pipeline gas business activities.
An individual who newly applies for operating bottled gas shall set up an enterprise. Fourteenth engaged in gas business shall obtain a gas business license according to law, and shall be handled in accordance with the following provisions:
(a) engaged in pipeline gas, compressed natural gas filling stations, bottled gas filling supply stations (points) business, to the gas management department of the people's government at the county level to apply for a gas business license;
(two) in the same city, state cross county administrative region, to the city, state people's government gas management department to apply for a gas business license; Cross-city, state administrative regions, respectively, to the city, state people's government gas management departments to apply for gas business license;
(three) engaged in the operation of gas vehicle filling stations, apply for gas business license to the competent department of the people's government at the county level where the gas vehicle filling station is located.
The gas management department shall complete the examination within 10 days from the date of accepting the application, and issue the gas business license to the qualified operators.
The gas business license shall be uniformly printed by the competent gas department of the provincial people's government.
