Sanmenxia City Mountain Protection Regulations
Chapter I General Provisions Article 1 In order to strengthen the protection of mountains, improve the ecological environment, and promote the ecological protection and high-quality development of the Yellow River Basin in this city, these regulations are formulated in accordance with the relevant laws and regulations and in the light of the actual situation. Article 2 The planning, protection, management and other activities of mountains within the administrative area of the city shall be governed by these regulations.

The provisions of relevant laws and regulations shall apply where not provided for in these regulations. Article 3 The mountains referred to in these regulations, refers to the natural mountains within the administrative area of the city, the specific scope of the municipal people's government to determine. Article 4 The protection of mountains shall adhere to the principles of ecological priority, integrated planning, classification and protection, scientific restoration and damage responsibility. Article 5 the municipal people's government unified leadership within the administrative area of the mountain protection work, the establishment of mountain protection work coordination mechanism, study of mountain protection in the major issues.

City, county (city, district) people's government shall incorporate the protection of mountains into the national economy and social development planning, implementation of responsibilities and funding.

Township (township) people's government, street offices in accordance with the arrangements of the higher people's government, to do a good job in the administrative area of the mountain protection work.

Village (neighborhood) people's committees to assist the township (town) people's government, street offices to carry out mountain protection work. Article 6 The competent departments of natural resources of the people's governments of cities and counties (cities and districts) shall carry out unified supervision and management of the work of mountain protection within their administrative areas.

The people's governments of cities, counties (cities and districts) development and reform, industry and information technology, ethnic religion, public security, civil affairs, finance, ecological environment, housing and urban-rural construction, urban management, transportation, water conservancy, agriculture and rural areas, forestry, culture, radio and television, and tourism, emergency management, big data management and other relevant departments in accordance with their respective responsibilities, to do a good job of the work of the mountain protection related to the administrative area. Article 7 The ownership units, management units, contractors and users of mountains shall fulfill their obligations to protect mountains and accept the supervision and management of the local people's government as well as the relevant departments. Article 8 The people's governments at all levels and their relevant departments, enterprises and institutions, relevant organizations shall carry out mountain protection publicity and education, enhance public awareness of mountain protection.

The news media should strengthen the public interest in mountain protection publicity and public opinion supervision. Article IX any unit or individual has the right to report encroachment, destruction of mountains. Received the report of the relevant departments should be investigated and handled in accordance with relevant regulations, and the confidentiality of the informant's information.

City, county (city, district) people's government in the mountain protection work has made remarkable achievements in units and individuals, should be given in accordance with relevant provisions of the commendation, praise, reward. Chapter II Planning and Management Article 10 The department in charge of natural resources of the municipal people's government shall, in conjunction with the relevant departments based on the overall planning of land space, etc., organize the preparation of special planning for the protection of mountains, reported to the municipal people's government for approval, and announced to the public.

The department in charge of natural resources of the people's governments of counties (cities and districts) shall, based on the municipal special plan for the protection of mountains, organize the preparation of a special plan for the protection of mountains in their own administrative areas, and publish it after approval by the people's governments of the counties (cities and districts) for the record of the department in charge of natural resources of the people's governments of the city.

Mountain protection special planning should be linked with other special planning, the preparation process should seek the views of relevant departments and the public. Article XI of the mountain protection special planning shall include mountain protection list, protection level, protection scope, legal plans, protection measures, restoration and management. Article XII of any unit or individual shall not change the legally approved special planning for mountain protection.

As a result of the overall national spatial planning modifications, national and provincial major projects such as the construction of the need to modify the special plan for mountain protection, should be in accordance with the planning and approval procedures, and will be modified to the community. Article XIII of the municipal people's government department in charge of natural resources shall, in conjunction with the relevant departments and counties (cities, districts) people's government according to the location of the mountain area, ecological function, water protection, natural landscape, human landscape, etc., mountain protection level, the establishment of mountain protection directory, and publicize to the community.

Mountain protection list is divided into key protection list and general protection list.

The protection of mountains in the protection list shall determine the scope of protection. Article 14 The mountains meeting one of the following conditions shall be included in the list of key protection:

(1) located within a certain range of the main stream of the Yellow River and its important tributaries;

(2) located in the core scenic spots of scenic spots, drinking water sources of the first level of protection, natural reserves at or above the provincial level, the nationally important wetland, the Ⅰ level of protection of woodlands, as well as the first level of national public welfare forests;

(c) within the scope of geological disaster hazardous areas, serious soil erosion and sensitive and fragile ecological environment;

(d) located in national geoparks, geological relics and historical and cultural heritage protection zones;

(e) located within a certain distance on both sides of the highway, national highway, railroad line;

(f) on the city's ecological safety, landscape or residential life has an important impact;

(vii) according to laws and regulations need to be included in the list of key protection of the mountain.

Mountains outside the scope of the preceding paragraph are included in the general protection list. Chapter III Protection Measures Article 15 The department in charge of natural resources of the municipal people's government shall, in conjunction with the relevant departments, carry out a background survey of mountain resources, and establish a base map of mountain resources; on the basis of the background survey, a census of mountain resources shall be organized once every five years, and a bulletin of mountain resources shall be compiled.

Cities, counties (cities, districts) people's governments in charge of natural resources shall, in accordance with national regulations, the administrative area of the mountain resources for unified registration and file management, the establishment of the corresponding database and information management system.
