In the big data kill, consumers are difficult to know the real price of goods or services, what they see can only be the operator through the analysis of their personal information specifically delineated for them, making them pay the most amount of money, which is a serious violation of the consumer's right to know.

The operator who implemented the big data to kill maturity did not fulfill the obligation to disclose specific information, and even intentionally informed of the false price, so that consumers made a wrong judgment to buy the goods or services on the basis of the untrue price, the behavior constitutes a fraud, and consumers can claim punitive damages.

"Killing familiarization" takes various forms, with three main manifestations:

One is differential pricing based on the different devices used by the user, such as setting different prices for Apple users and Android users;

The other is differential pricing based on the place where the user spends his time, such as setting higher prices for users who are far away from the shopping mall.

Third, according to the different frequency of consumption and different pricing, in general, the higher the frequency of consumption of the user on the price of the ability to bear stronger.

Therefore, on top of compensating the losses suffered by the consumers, the operator who implemented the big data killing shall also increase the compensation for their losses as requested by the consumers, and the amount of the increased compensation shall be three times of the cost of the consumer's purchase of the goods or acceptance of the service; and if the amount of the increased compensation is less than 500 yuan, it shall be 500 yuan.
