1. If the judgment has entered into force before January 1, 2013, the retrial period of 2 years applies. If it is effective after January 1, 2013, then the retrial period is 6 months. 2. Article 205 of the Civil Procedure Law

The application for retrial shall be filed within six months after the judgment or ruling has become legally effective; if there are circumstances stipulated in the provisions of the first, third, twelfth, or thirteenth subparagraphs of Article 200 of this Law, the application shall be filed within six months from the date of the person who knows or should have known about it.

Article 198 If the presidents of the people's courts at all levels find errors in the judgments, rulings, or conciliations of the courts that have become legally effective, and believe that they need to be retried, they shall submit them to the trial committee for discussion and decision.

(3) the judgment or ruling of the retrial contains obvious errors.
