Regulations of Zhengzhou Municipality on the Administration of Housing Use Safety
Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the relevant laws and regulations and in the light of the actual situation of this Municipality in order to strengthen the management of housing use safety, safeguard public safety and interests, and protect the personal and property safety of citizens, legal persons and other organizations. Article 2 These Regulations shall apply to the safety management activities of houses built and put into use according to law within the administrative area of this Municipality.

The use safety management of houses in historical buildings, cultural relics protection units, scenic spots, nature reserves, places for religious activities and civil air defense projects, as well as the use safety management of professional facilities and equipment such as house fire protection, elevators, water supply, power supply, heating, gas, communication, lightning protection and earthquake resistance shall be implemented in accordance with the provisions of relevant laws and regulations.

Measures for the disposal of illegal buildings shall be formulated separately by the Municipal People's Government. Article 3 The term "house use safety management" as mentioned in these Regulations refers to the safety management activities such as inspection and maintenance, safety appraisal, risk management, decoration and termite control during the use of houses. Article 4 The safety management of house use shall follow the principles of putting prevention first, combining prevention with control, territorial management and safe use. Article 5 The people's governments of cities and counties (cities, districts) shall strengthen the organization and leadership over the management of housing use safety, make overall plans and coordinate major issues concerning housing use safety, and establish and improve the emergency handling mechanism for major emergencies concerning housing use safety.

City housing security and real estate management department is the competent department of housing safety in the city, responsible for the overall planning, coordination, supervision and guidance of housing safety management in the city; County (city, district) housing use safety management department is specifically responsible for the administrative area of housing use safety management.

Township (town) people's governments and sub-district offices shall conduct daily supervision and management on the safety of housing use within their respective jurisdictions.

Development and reform, urban and rural construction, natural resources and planning, finance, urban management, public security, civil affairs, emergency management, big data management and other departments should do a good job in the safety management of housing use within their respective responsibilities. Article 6 The people's governments of cities and counties (cities, districts) shall incorporate the special funds for housing use safety management into the fiscal budget at the same level to ensure the implementation of housing use safety management.

City, county (city, district) people's governments shall establish and improve the housing use safety assistance mechanism, set up special funds for housing use safety assistance, and provide help for housing safety appraisal and dangerous housing management of families with special difficulties. The specific measures shall be formulated separately by the Municipal People's Government. Seventh housing safety appraisal, decoration, property management and other industry associations should strengthen industry self-discipline, assist relevant departments and units to do a good job in housing use safety management, and accept social supervision. Article 8 The municipal housing security and real estate management departments and the county (city, district) housing use safety management departments shall set up and publish telephone numbers for reporting complaints, promptly accept reports and complaints that endanger the safety of housing use, and handle them according to law.

Encourage units and individuals to report and complain about acts that endanger the safety of housing use. Chapter II Safe Use of Houses Article 9 The owner of a house is the person responsible for the safe use of the house.

The public housing management unit is responsible for the safety of public housing.

The house owner, lessee, borrower, other actual users of the house and house trustee shall use the house in accordance with the provisions of laws and regulations and the contract, and bear corresponding responsibilities for the safety of the use of the house. Tenth people responsible for the use of housing shall bear the following responsibilities for the use of housing:

(a) the use of housing in accordance with the design purposes, the nature of use and the purpose of housing recorded in the ownership certificate;

(two) to undertake the responsibility for the safe use of building structures, curtain walls and their ancillary facilities and the management of hidden dangers;

(three) to cooperate with the government and relevant departments to organize the implementation of housing safety hazards investigation, dangerous housing management and emergency disposal;

(four) to take timely preventive measures against dangerous houses;

(five) other duties as prescribed by laws and regulations. Eleventh entrusted property services and other ways to manage the house, the property service enterprise or other managers shall bear the daily management responsibilities such as inspection, repair and maintenance in accordance with the contract, and establish housing safety files.

The implementation of self-management, * * * part of the daily safety management responsibility shall be borne by the person responsible for the use of housing safety.

The daily safety management responsibility of the exclusive part of the house shall be borne by the person responsible for housing safety. Twelfth prohibit the implementation of the following acts endangering the safety of housing use:

(four) to reduce the indoor elevation of the bottom floor of the house;

(five) to change the original architectural design purpose of the house without authorization;

(6) Dismantling or changing the main structure of shopping malls, hotels, restaurants, theaters, stadiums and other large buildings. , with the overall functions of earthquake resistance, fire prevention and civil air defense;

(seven) other acts that endanger the safety of housing use prohibited by laws and regulations.
