These Measures are formulated in accordance with relevant laws and regulations and in light of the actual situation in the city in order to promote and regulate the opening and utilization of public ****data in the city, to enhance the government's governance capacity and the level of public ****service, and to promote the development of the digital economy. Article 2 (Scope of Application)
These Measures shall apply to the opening of public **** data and its related management activities within the administrative area of the city.
Public **** data management involving state secrets, in accordance with relevant confidentiality laws and regulations. Article 3 (Definitions)
The public **** data referred to in these Measures refers to all kinds of data resources collected and generated by administrative organs at all levels of the city as well as institutions performing the functions of public **** management and services (hereinafter collectively referred to as the public **** management and service institutions) in the process of performing their duties in accordance with the law.
The public **** data openness referred to in this method refers to the public **** management and service institutions within the scope of the public **** data for the community to provide public **** services that have the originality, machine-readable, and can be reused for socialization of the data set. Article IV (working principles)
The city's public **** data open work, follow the "demand-oriented, safe and controllable, hierarchical classification, unified standards, convenient and efficient" principle. Article 5 (division of responsibilities)
The municipal government office is responsible for promoting and supervising the city's public **** data open work.
The municipal department of economy and information technology is responsible for guiding and coordinating the promotion of the city's public **** data openness, utilization and related industrial development.
The Municipal Big Data Center is responsible for the construction, operation and maintenance of the Municipal Unified Open Platform for Public **** Data (hereinafter referred to as the Open Platform), and the formulation of relevant technical standards.
Departments determined by the people's governments of the districts are responsible for guiding, promoting and coordinating the work of public **** data opening in their administrative areas.
Other public **** management and service organizations are responsible for the work related to the opening of public **** data in accordance with relevant laws, regulations and rules. Article 6 (Data Security Protection)
The municipal and district people's governments and all relevant departments shall, in the process of opening up public **** data, implement the requirements for data security management, take measures to protect commercial secrets and personal privacy, and prevent public **** data from being illegally accessed or improperly utilized. Article 7 (Coordination Mechanism)
The Municipal People's Government establishes and improves the coordination mechanism for the work of public ****data openness, and coordinates the resolution of major matters of public ****data openness. Article 8 (Expert Committee)
The municipal department of economic informatization shall establish an expert committee on public **** data opening composed of experts from universities, scientific research institutes, enterprises and relevant departments.
The public **** data opening expert committee is responsible for researching and justifying difficult issues in public **** data opening, assessing the risk of public **** data utilization, and making professional recommendations on public **** data opening. Chapter II Open Mechanism Article 9 (Subjects of Data Opening)
Departments of the Municipal People's Government, district people's governments, and other public **** management and service organizations (hereinafter collectively referred to as the subject of data opening) are responsible for the opening of public **** data in their own systems, administrative regions and units, respectively.
For public **** data included in the scope of openness, the data open subject shall be listed in the city's public **** data resource catalog. Article 10 (open focus)
The municipal department of economy and information technology shall, according to the needs of the city's economic and social development, determine the annual focus of public **** data opening. Closely related to people's livelihood, the urgent need for social, industry value-added potential and industrial strategic significance of the public **** data, should be prioritized into the public **** data open focus.
The municipal economic information technology department shall listen to the opinions of relevant industry authorities and the public when determining the focus of public **** data opening.
Natural persons, legal persons and unincorporated organizations may put forward their demands and opinions and suggestions on the scope of public ****data opening through the open platform. Article 11 (Classification)
The municipal department of economy and information technology shall, in conjunction with the municipal big data center, formulate rules for the classification of public **** data in the city, taking into account factors such as public **** data security requirements, personal information protection requirements and application requirements. The main body of data openness should be in accordance with the classification rules, combined with industry and regional characteristics, to develop the corresponding implementation rules, and public **** data classification, to determine the type of openness, open conditions and regulatory measures.
The public **** data involving commercial secrets, personal privacy, or laws and regulations shall not be opened up, included in the non-open category; the public **** data with higher requirements for data security and processing capacity, higher timeliness, or the need for continuous access, included in the conditional open category; and other public **** data included in the unconditional open category.
Non-open public **** data that are declassified or desensitized in accordance with the law, or where the relevant right holders agree to open them, they can be included in the unconditional open category or conditional open category. Article 12 (Open List)
The main body of data openness shall, in accordance with the annual openness priorities and the rules for grading and classifying public **** data, formulate an open list of public **** data (hereinafter referred to as the open list) within the scope of the city's public **** data resource catalog, listing the public **** data that can be opened up to the community. Public ****data obtained through ****sharing and other means are not included in the unit's open list.
The open list shall be labeled with information such as data fields, data summaries, data items and data formats, and shall specify the types of data to be opened, the conditions of opening and the frequency of updating.
The municipal economic information technology department shall work with the data open subject to establish the open list review mechanism. After review, the open list should be published through the open platform.
