People's governments of provinces, autonomous regions and municipalities directly under the central government, and the ministries and commissions of the State Council, as well as all directly subordinate institutions:
Promoting mass entrepreneurship and mass innovation is a source of motivation for development, and also the way of enriching the people, the plan for fairness, and the strategy for a strong country. It is of great significance to promote economic restructuring, build a new engine of development, enhance the new power of development, and take the road of innovation-driven development, and it is a major initiative to stabilize growth, expand employment, stimulate the wisdom and creativity of hundreds of millions of people, and promote vertical social mobility and fairness and justice. According to the deployment of the 2015 "Government Work Report", in order to reform and improve the relevant institutional mechanisms, to build a universal policy support system, to promote the capital chain to guide the entrepreneurial innovation chain, the entrepreneurial innovation chain to support the industrial chain, the industrial chain to drive the chain of employment, the following views are put forward.
One, fully understand the importance of promoting mass entrepreneurship and innovation
-Promoting mass entrepreneurship and innovation is an inevitable choice to cultivate and generate a new impetus for economic and social development. With China's resource and environmental constraints increasingly strengthened, the scale of the factor driving force gradually weakened, the traditional high-input, high-consumption, crude development mode is unsustainable, economic development has entered a new normal, the need to shift from factor-driven, investment-driven to innovation-driven. To promote mass entrepreneurship and innovation, it is necessary to eliminate all kinds of institutional restrictions and shackles that are unfavorable to the development of entrepreneurship and innovation through structural reforms and institutional mechanism innovations, and to support all kinds of market players to continuously start new enterprises, develop new products and markets, and cultivate new industries, so as to form the "sky-high" small enterprises and "top-heavy" large enterprises. The development pattern of "roofing" of small enterprises and large enterprises, realizing innovation-driven development, creating a new engine and forming a new momentum.
--Promoting mass entrepreneurship and innovation is a fundamental measure for expanding employment and realizing the way to enrich the people. China has a population of more than 1.3 billion and a labor force of more than 900 million, with a large number of college graduates, rural transfer labor force, urban people in difficulty, and retired military personnel each year, and a huge potential for transforming human resources into human capital, but the total pressure on employment is greater, and structural contradictions are highlighted. To promote mass entrepreneurship and innovation, it is necessary to create a fair and competitive entrepreneurial environment by changing government functions and building a service-oriented government, so that various types of market entrepreneurial subjects, such as science and technology personnel, college graduates, rural migrant workers, retired military personnel, and unemployed people, who have dreams, willingness, and ability, can "catch the water like a fish in the water", and increase their incomes through entrepreneurship, and let more people get rich. Let more people get rich, promote income distribution structure adjustment, realize innovation support entrepreneurship, entrepreneurship driven by the positive interactive development of employment.
-Promoting mass entrepreneurship and innovation is an effective way to stimulate the innovation potential and entrepreneurial vigor of the whole society. At present, the concept of entrepreneurship and innovation in China has not been y rooted in people's hearts, the entrepreneurship education and training system is still not sound, the ability to create and start a business is insufficient, and a favorable environment that encourages innovation and tolerates failure has not yet been formed. Promote public entrepreneurship, innovation, is to strengthen the whole society to innovation as the core of entrepreneurship education, promote "dare to be first, the pursuit of innovation, indomitable" entrepreneurial spirit, thick planting of innovation culture, and constantly enhance the awareness of entrepreneurship and innovation, so that entrepreneurship and innovation has become a society *** with the same pursuit of values and behavioral habits.
Second, the general idea
In accordance with the "four comprehensive" strategic layout, adhere to the reform to promote and accelerate the implementation of innovation-driven development strategy, give full play to the decisive role of the market in resource allocation and better play the role of the government, increase the efforts of decentralization, relaxation of policies, liberalization of the market, and activation of the main body, to form a favorable atmosphere conducive to entrepreneurship and innovation. Form a favorable atmosphere conducive to entrepreneurship and innovation, so that millions of entrepreneurs can become active and converge into a huge kinetic energy for economic and social development. Continuously improve the institutional mechanism, improve inclusive policies and measures, strengthen coordination and build a policy environment, institutional environment and public **** service system conducive to the development of mass entrepreneurship and innovation, so that entrepreneurship leads to employment and innovation promotes development.
--Insist on deepening reform and creating an entrepreneurial environment. Through structural reforms and innovations, further simplify administration, decentralize, integrate management and optimize services, enhance the system supply of entrepreneurship and innovation, improve relevant laws and regulations, support policies and incentives, create an equal and inclusive environment, and promote vertical social mobility.
-Adhering to the demand-oriented, unleash entrepreneurial vitality. Respect the laws of entrepreneurship and innovation, adhere to the people-oriented, and effectively solve the bottlenecks faced by entrepreneurs, such as financial needs, market information, policy support, technical support, public **** services, to maximize the release of entrepreneurial and innovative vitality of all types of market players, to open up a new space for employment, to expand the development of new horizons and to emancipate and develop productive forces.
--Insist on policy synergy to realize the roots. Strengthen entrepreneurship, innovation, employment and other types of policy coordination, departmental and local policy linkage, to ensure that entrepreneurship support policies can be operated, can be landed. Encourage the conditional areas to pilot, explore the formation of replicable, scalable entrepreneurship and innovation experience.
--Insist on open ****sharing and promote model innovation. Strengthen the openness of entrepreneurship and innovation public ****service resources ****sharing, integration and utilization of global entrepreneurship and innovation resources, and realize the free flow of entrepreneurship and innovation factors such as talents across regions and industries. Relying on "Internet+" and big data, we will promote innovative business models in various industries, and establish and improve mechanisms for entrepreneurship and innovation, including online and offline, domestic and overseas, and open cooperation between the government and the market.
Third, innovate the system and mechanism to realize the facilitation of entrepreneurship
(1) Improve the market environment for fair competition. Further transform government functions, increase the supply of public **** products and services, and provide more opportunities for entrepreneurs. Gradually clean up and abolish systems and regulations that hinder the development of entrepreneurship and break down local protectionism. Accelerate the introduction of a fair competition review system and establish a unified, transparent, orderly and standardized market environment. Anti-monopoly and anti-unfair competition will be enforced in accordance with the law, eliminating monopoly agreements and abuse of dominant market position, as well as other unfair competition behaviors that are detrimental to the development of entrepreneurship and innovation. Clean up and standardize enterprise-related fee items, improve the fee catalog management system, and formulate measures for supervision during and after the incident. It will establish and standardize the system for releasing enterprise credit information, formulate methods for managing the list of enterprises in serious violation of the law, link the credit of entrepreneurial entities with market access and enjoyment of preferential policies, and improve the mode of supervision of entrepreneurship and innovation based on credit management.
(2) Deepening the reform of the commercial system. Accelerate the implementation of the "three certificates in one" and "one code in one license" for industrial and commercial business licenses, organizational code certificates and tax registration certificates, implement the "license before certificate" reform, and promote the application of full electronic registration and electronic business licenses. and the application of electronic business license. Supporting localities to relax the restrictions on the registration conditions for newly registered business premises in light of actual circumstances, promoting the reform of residence registration such as "one address, multiple licenses" and cluster registration, and providing convenient business registration services for entrepreneurship and innovation. Negative lists for market access have been established, and unreasonable restrictions on industry access have been eliminated. It will carry out a pilot program of simple enterprise cancellation and establish a convenient market exit mechanism. Relying on the enterprise credit information publicity system to establish a directory of small and micro-enterprises, and enhance the transparency of information on entrepreneurial enterprises.
(3) Strengthening the protection of entrepreneurial intellectual property rights. It will study ways to protect the intellectual property rights of business models and other new forms of innovation. Actively promote intellectual property trading and accelerate the establishment of a national intellectual property operation public **** service platform. Improve the mechanism of rapid defense of intellectual property rights and assistance in the defense of intellectual property rights, and shorten the cycle of examination of rights and handling of infringement. It will focus on investigating and dealing with a number of major cases of IPR infringement, increase penalties for repeated infringement and malicious infringement, and explore the implementation of a punitive compensation system. Improve the mechanism for rights holders to defend their rights, rationally divide the burden of proof for rights holders, and improve administrative mediation and other alternative dispute resolution methods.
(4) Improve the mechanism of entrepreneurial talent training and mobility. Cultivate entrepreneurship and entrepreneurial quality education into the national education system, and institutionalize and systematize entrepreneurship education and training for the whole society. Accelerate the improvement of entrepreneurship curriculum and strengthen the construction of entrepreneurship practical training system. Strengthen the popularization and education of entrepreneurship and innovation knowledge, so as to make mass entrepreneurship and innovation y rooted in people's hearts. Strengthen the construction of entrepreneurship mentor teams and improve the level of entrepreneurship services. Accelerate the reform of the social security system, break down institutional barriers to the free flow of talents, and realize the smooth flow of talents from party and government organs, enterprises and public institutions, and all aspects of society. Accelerate the establishment of entrepreneurship and innovation performance evaluation mechanism, so that a number of rich entrepreneurial spirit, the courage to bear the risk of talent to stand out.
Four, optimize financial and tax policies, and strengthen entrepreneurial support
(E) increase financial support and coordination. Finance at all levels should be based on the needs of entrepreneurship and innovation, co-ordination of various types of support for small and micro-enterprises and entrepreneurship and innovation funds, to increase support for entrepreneurship and innovation, strengthen the implementation of the budget and supervision of funds, and strengthen the use of funds performance evaluation. Support local governments in a position to set up entrepreneurship funds to support the development of entrepreneurship and innovation. Under the premise of ensuring fair competition, it encourages appropriate preferential treatment for office space, water, energy, network and other software and hardware facilities of incubators such as crowd creation space, so as to reduce the burden of entrepreneurs.
(VI) Improving inclusive tax measures. Implement various preferential tax policies to support the development of small and micro enterprises. Implement preferential tax policies for science and technology business incubators, university science and technology parks, additional deduction for R&D expenses, and accelerated depreciation of fixed assets. Apply preferential tax policies for science and technology business incubators to new-type incubators such as qualified crowdsourcing spaces. In accordance with the direction and requirements of the tax reform, the relevant tax support policies will be studied in an integrated manner for investments, including angel investments, that are invested in innovative activities at the seed and start-up stages. Revise and improve the method of recognizing high-tech enterprises, and improve the policy of tax credit of 70% of taxable income for venture capital enterprises. It will grasp the opportunity to promote the pilot tax policy of the Zhongguancun National Innovation Demonstration Zone, and extend to the whole country the pilot policy of installment payment of individual income tax on the conversion of share capital by enterprises and the pilot policy of installment payment of individual income tax on equity awards. It will implement tax policies to promote entrepreneurship and employment of college graduates, persons with disabilities, retired military personnel and registered unemployed persons.
(7) Playing a supportive role in government procurement. Improve government procurement policies to promote the development of small and medium-sized enterprises, strengthen policy guidance and supervision and inspection of procurement units, and urge procurement units to improve the preparation of procurement plans and the management of project reservations, so as to enhance the effect of policy support for the development of small and medium-sized enterprises. Increase the procurement of innovative products and services, and closely integrate government procurement with support for entrepreneurship development.
V. Enlivening the Financial Market and Achieving Convenient Financing
(viii) Optimizing the Capital Market. Support qualified entrepreneurial enterprises to go public or issue notes for financing, and encourage entrepreneurial enterprises to raise funds through the bond market. Actively study the issuance and listing system for Internet and high-tech enterprises that have not yet made profits to the Growth Enterprise Market, and promote the establishment of a board for strategic emerging industries in the Shanghai Stock Exchange. Accelerating the pilot transfer of the National Small and Medium-sized Enterprise Stock Transfer System to the GEM. Studying to solve the systemic obstacles to the listing of special shareholding structure type of entrepreneurial enterprises on the domestic market, and improving the rules of the capital market. Regulating the development of regional equity markets serving small, medium and micro enterprises, promoting the establishment of a docking mechanism for equity registration between business registration departments and regional equity markets, and supporting equity pledge financing. Support qualified issuers to issue innovative varieties of corporate bonds such as credit-enhancing pooled bonds for small and micro enterprises.
(ix) Innovative bank support. Encourage banks to improve the professional level of financial services for entrepreneurial and innovative enterprises, and continuously innovate their organizational structure, management methods and financial products. Promote banks to strengthen cooperation with other financial institutions to provide targeted equity and debt financing support for entrepreneurial and innovative activities. Encourage banking financial institutions to provide one-stop and systematic financial services such as settlement, financing, wealth management and consulting to entrepreneurial enterprises.
(j) Enriching new modes of entrepreneurial financing. It supports the development of Internet finance, guides and encourages the standardized development of crowdfunding financing platforms, carries out pilot projects of public and small-scale equity crowdfunding financing, and strengthens risk control and standardized management. Enrich and improve the policy of guaranteed loans for entrepreneurship. Support the participation of insurance funds in entrepreneurship and innovation, and develop new businesses such as mutual insurance. Improve the system of valuation, pledge and circulation of intellectual property rights, and promote the normalization and large-scale development of services such as pledge financing of intellectual property rights, securitization of patent licensing fees and patent insurance in accordance with the law, so as to support the development of intellectual property finance.
VI. Expanding Venture Capital and Supporting the Growth of Entrepreneurial Startups
(XI) Establishing and improving the guidance mechanism for venture capital. Continuously expanding social capital to participate in the emerging industries venture capital program to participate in the size of the fund, expanding the direct financing platform, and guiding the entrepreneurial investment to the front-end extension of the growth of entrepreneurial enterprises to start more. Continuously improve the policy system, institutional system, financing system, supervision and early warning system of venture capital in emerging industries, and accelerate the establishment of assessment and evaluation system. It will accelerate the establishment of the National Venture Capital Guidance Fund for Emerging Industries and the National Small and Medium-sized Enterprises Development Fund, and gradually set up a market-oriented and long-term operation mechanism to support entrepreneurship, innovation and the development of emerging industries. It will develop new modes such as joint investment and explore the establishment of a risk compensation mechanism. Encourage local governments to establish and improve venture capital guidance funds. Strengthen the legislation on venture capital and improve the policies and regulations to promote angel investment. Promote synergies among the National Venture Capital Guidance Fund for Emerging Industries, the Venture Capital Guidance Fund for Science and Technology-based Small and Medium-sized Enterprises, the National Science and Technology Achievement Transformation Guidance Fund, and the National Small and Medium-sized Enterprise Development Fund. Promote the construction of Venture Capital Industry Association and strengthen the self-discipline of the industry.
(xii) Broaden the supply channels of venture capital funds. Accelerate the implementation of the three-year action plan for "dual creation" in emerging industries, establish a number of demonstration bases for "dual creation" in emerging industries, and guide social capital to support mass entrepreneurship. Promote commercial banks to establish market-oriented long-term cooperation with venture capital institutions on the premise of legal compliance and risk isolation. Further reduce the threshold for commercial insurance funds to enter venture capital. Promote the development of new modes such as investment and loan linkage, investment and insurance linkage, and investment and debt linkage, and continuously increase financing support for entrepreneurial and innovative enterprises.
(xiii) Developing state-owned capital for entrepreneurial investment. It will study and formulate systematic policies and measures to encourage state-owned capital to participate in entrepreneurial investment, and improve the incentive and restraint mechanism, supervision and management mechanism of state-owned entrepreneurial investment institutions. Guiding and encouraging central enterprises and other state-owned enterprises to participate in venture capital funds in emerging industries, the establishment of state-owned capital venture capital funds, etc., to give full play to the role of state-owned capital in entrepreneurship and innovation. Study and improve the exemption policy of transferring state-owned shares of state-owned venture capital institutions.
(14) Promoting the "introduction" and "going out" of venture capital. It urgently revises the relevant administrative regulations on foreign-invested venture capital enterprises, relaxes the access to foreign investment in accordance with the management principle of consistency between domestic and foreign capital, improves the management system of foreign-funded venture capital institutions, simplifies the management process, and encourages foreign investors to carry out the business of venture capital. Ease the investment restrictions on foreign-funded venture capital funds and encourage the development of Sino-foreign joint venture capital institutions. Guide and encourage venture capital institutions to increase investment in high-end R&D projects abroad and actively share the results of high-end technologies abroad. Improve the management of foreign investment in venture capital according to the investment field, purpose and scale of funds raised.
VII. Developing Entrepreneurial Services and Building Entrepreneurial Ecology
(XV) Accelerating the development of business incubation services. Vigorously develop new incubators such as Innovation Workshop and Garage Coffee, expand and strengthen the crowdsource space, and improve business incubation services. Guide and encourage various types of business incubators to combine with angel investment and venture capital to improve the investment and financing model. Guide and promote the combination of business incubation with the transfer of technological achievements from universities, research institutes and other institutions, and improve technological support services. It guides and encourages domestic capital to cooperate with foreign countries to set up new business incubation platforms, introduces advanced business incubation models from abroad, and improves incubation capacity.
(16) vigorously develop third-party professional services. Accelerate the development of third-party professional services such as business management, financial consulting, marketing, human resources, legal counseling, intellectual property rights, inspection and testing, modern logistics, etc., to continuously enrich and improve entrepreneurial services.
(17) Developing "Internet+" entrepreneurship services. Accelerate the development of "Internet+" entrepreneurship network system, build a number of entrepreneurship and innovation bases for small and micro-enterprises, promote the combination of entrepreneurship and innovation, entrepreneurship and employment, and online and offline, and reduce the threshold and cost of entrepreneurship for the whole society. Strengthening the openness of government data***sharing, and promoting the opening up of computing, storage and data resources to entrepreneurs by large Internet enterprises and basic telecommunications enterprises. Actively promote crowdsourcing, user participation in design, cloud design and other new R&D organizational models and entrepreneurial innovation models.
(xviii) Researching and exploring new modes of public **** services such as entrepreneurship vouchers and innovation vouchers. Conditional localities continue to explore the provision of social training, management consulting, inspection and testing, software development, R&D and design services to entrepreneurs and innovative enterprises through entrepreneurship vouchers, innovation vouchers, etc., establish and standardize the relevant management system and operation mechanism, and gradually form replicable and scalable experiences.
Eight, the construction of entrepreneurship and innovation platform, enhance the support role
(19) to build entrepreneurship and innovation public **** platform. Strengthen the integration of entrepreneurship and innovation information resources, establish a centralized release platform for entrepreneurship policies, improve the professional and networked service system, and enhance the transparency of entrepreneurship and innovation information. Encourage the development of various types of public welfare forums, entrepreneurship forums, entrepreneurship training and other activities to enrich the form and content of the entrepreneurship platform. Support various entrepreneurship and innovation competitions, and regularly organize events such as the China Innovation and Entrepreneurship Competition, the China Agricultural Science and Technology Innovation and Entrepreneurship Competition and the Innovation Challenge Competition. Strengthen and improve the construction of the network of small and medium-sized enterprise public **** service platforms. Give full play to the role of enterprises as the main body of innovation, encourage and support conditional large-scale enterprises to develop entrepreneurial platforms, invest in and merge and acquire small and micro-enterprises, etc., and support the entrepreneurship of internal and external entrepreneurs in enterprises, so as to enhance the vitality of entrepreneurship and innovation in enterprises. Establish the necessary guidance and assistance mechanisms for failed entrepreneurs to start up again, and continuously enhance entrepreneurial confidence and entrepreneurial ability. Accelerate the establishment of the statistical index system for entrepreneurial enterprises, angel investment and venture capital, standardize the statistical caliber and survey method, and strengthen monitoring and analysis.
(xx) Utilizing entrepreneurship and innovation technology platforms. Establish a long-term mechanism for opening up scientific and technological infrastructure, large-scale scientific research instruments and patent information resources to society as a whole. Improve the mechanism of opening state-level scientific research platforms (bases) such as national key laboratories to the society, and provide strong support for mass entrepreneurship and innovation. Encourage enterprises to establish a number of specialized and market-oriented technology transfer platforms. Encourage the development of socialized services for entrepreneurs based on advanced technologies and development models such as three-dimensional (3D) printing and network manufacturing. Guide and support conditional leading enterprises to create special service platforms to provide capital, technology and service support for internal and external entrepreneurs. Accelerate the establishment of coordination mechanisms for the implementation of dual-use technology projects, information interaction and standardization, and promote the integration of military and civilian innovation resources.
(xxi) Developing regional platforms for entrepreneurship and innovation. Supporting provinces (autonomous regions and municipalities) that carry out comprehensive innovation reform experiments and national comprehensive reform pilot zones, relying on reform pilot platforms to actively explore in the reform of entrepreneurship and innovation systems and mechanisms, play a demonstration and driving role, and provide replicable and scalable experience for the construction of entrepreneurship and innovation systems. Relying on entrepreneurship and innovation resource-intensive areas such as pilot free trade zones, national demonstration zones for independent innovation, and strategic emerging industry agglomeration zones, it will create a number of entrepreneurship and innovation centers with global influence. Guiding and encouraging entrepreneurship and innovation-oriented cities to improve their environment and promote regional cluster development. Promote the implementation of urban demonstration of small and microenterprise entrepreneurship bases. Encourage places with the conditions to introduce support policies with their own characteristics, and actively revitalize idle commercial buildings, industrial plants, corporate warehouses, logistics facilities and family residences, rental housing and other resources, so as to provide entrepreneurs with low-cost office space and living conditions.
Nine, stimulate creative energy, the development of innovative entrepreneurship
(xxii) to support researchers to start their own businesses. Accelerate the implementation of colleges and universities, research institutes and other professional and technical personnel to leave their posts to start their own businesses, agreed to leave their posts can be retained within three years of the personnel relationship, to establish and improve the mechanism of two-way flow of scientific researchers. Further improve the system rules for listing equity incentives and employee stock ownership plans for innovative small and medium-sized enterprises. Encourage qualified enterprises to mobilize the enthusiasm of scientific researchers for entrepreneurship through equity, options, dividends and other incentives in accordance with relevant regulations. Support and encourage scientific and technological societies such as societies, associations and research societies to provide consulting services for scientific and technological personnel and entrepreneurial enterprises.
(xxiii) Supporting entrepreneurship of college students. In-depth implementation of college student entrepreneurship leadership program, integration and development of employment and entrepreneurship funds for college graduates. Guiding and encouraging colleges and universities to coordinate resources, and grasp the implementation of college student entrepreneurship guidance service institutions, personnel, venues, funding, etc.. Guiding and encouraging successful entrepreneurs, famous entrepreneurs, angels and venture capitalists, experts and scholars to serve as part-time entrepreneurship mentors, providing entrepreneurship counseling including business start-up programs, business start-up channels and so on. To establish and improve the management method of flexible academic system, and to support college students to retain their academic status to take a break from their studies to start their own business.
(xxiv) Supporting overseas talents to start businesses in China. Give full play to the role of entrepreneurial leadership of returning talents, especially leading and high-end talents. It will continue to promote the opening of the human resources market to the outside world, and establish and improve the mechanism for the introduction of high-end entrepreneurial and innovative talents from abroad. It will further relax the conditions for foreign high-end talents to come to China to apply for visas and permanent residence certificates, simplify the approval process for setting up enterprises, and explore the adjustment from prior approval to post-filing. Guiding and encouraging localities to give one-time start-up capital to returning high-end talents and overseas high-end talents who come to China to set up high-tech enterprises, and to improve relevant measures in terms of spouse employment, children's enrollment in schools, medical care, housing and social security. Strengthen the construction of offshore entrepreneurial bases for overseas scientific and technological talents, and introduce more foreign entrepreneurial and innovative resources into China.
X. Expanding entrepreneurial channels in urban and rural areas and realizing entrepreneurship-led employment
(25) Supporting the extension of e-commerce to the grassroots level. Guide and encourage the development of market-oriented online business entrepreneurship platforms integrating office services, investment and financing support, entrepreneurial counseling, and channel development. Encourage leading enterprises to establish e-commerce trading service platforms, commodity distribution platforms and logistics centers in conjunction with the characteristics of the countryside, and promote rural entrepreneurship based on the Internet. Encourage e-commerce third-party trading platforms to sink channels and drive urban and rural grassroots entrepreneurs to rely on their platforms and business networks to start their own businesses. Improve relevant measures in favor of the development of small and medium-sized online businesses, and support the development of financing and lending business for small and medium-sized online businesses on the premise of risk control and commercial sustainability.
(26) Supporting the development of entrepreneurial agglomeration in hometowns. Combined with the characteristics of urban and rural areas, the establishment of market-competitive collaborative entrepreneurial models, and the formation of distinctive entrepreneurial alliances of returnees. Guiding the entrepreneurs to integrate into the specialty markets, creating entrepreneurial clusters and advantageous industrial clusters with regional characteristics.
