Article 5 The department in charge of natural resources is responsible for the guidance, coordination and inspection of mine ecological restoration.
The competent department of ecological environment is responsible for the supervision and management of pollution prevention and control related to the ecological restoration of mines.
The competent department of water administration is responsible for the supervision and management of soil and water conservation related to mine ecological restoration.
The emergency management department is responsible for the supervision and management of tailing pond safety and other comprehensive supervision and management of production safety related to mine ecological restoration.
Development and reform, public security, finance, agriculture and rural areas, culture and tourism, government services and big data management units, within their respective areas of responsibility to do a good job related to mine ecological restoration. Article 6 The people's governments of cities and counties (cities and districts) and their relevant departments shall strengthen publicity and education on mine ecological restoration, and enhance the public's awareness of mine ecological protection. Article 8 encourages the use of market-oriented approach to promote mine ecological restoration. Encourage units and individuals to invest in mine ecological restoration according to law.
Encourage the ecological restoration of mines and the protection of history and culture, as well as the development of science education, tourism, comprehensive agricultural development, sports and leisure, characteristics of the town. Chapter II mine ecological restoration Article 10 The municipal natural resources department shall, in conjunction with the ecological environment, emergency management and other relevant departments, in accordance with relevant laws and regulations, the preparation of mine ecological restoration planning, reported to the municipal people's government for approval after the announcement and implementation.
County (city, district) people's government shall be based on mine ecological restoration planning, the development of the jurisdiction of the annual plan and implementation. Article XII of the mine ecological restoration planning shall include the basic situation of mine ecology, ecological restoration of the target tasks, key management area, safeguard measures and other content should be included.
The preparation of mine ecological restoration planning, shall take the discussion, hearing or other means to solicit the views of relevant units, experts and the public. Article XIII of the mine ecological restoration planning shall be strictly enforced; do need to adjust, shall be handled in accordance with the original approval procedures. Article XIV of the municipal people's government shall every five years to organize an assessment of the implementation of mine ecological restoration planning, and the results of the assessment as an important basis for adjusting the mine ecological restoration planning. Article 15 The mining rights holders are responsible for the ecological restoration of mines.
The ecological restoration of historical abandoned mines shall be organized and implemented by the people's governments of the counties (cities and districts) where they are located. The list of historical abandoned mines shall be published by the municipal people's government. Article 19 The mining right holder shall take the following ecological restoration measures in the mining activities of mineral resources:
(1) for the arable land, forest land, grassland, etc., which may be damaged, topsoil stripping, layered storage, layered backfill, priority for reclamation of the land for soil improvement, and to take governance measures to avoid or reduce soil pollution;
(2) for the vegetation destruction of the exposed mountain, rock pits, etc., to carry out ecological re-greening;
(c) to backfill, reclaim, etc., the hollow area that has collapsed;
(d) to take anti-seepage and anti-dispersal measures for tailing ponds to prevent environmental pollution, etc.; to carry out land reclamation or ecological re-greening in a timely manner after the closure of the ponds and the elimination of the ponds;
(e) to take measures for the construction of retaining walls, interceptor ditches, water catchment ponds, sand sedimentation ponds, and other measures for the mine and its surroundings; and to take measures to avoid or minimize soil pollution.
