The elevators mentioned in these Regulations include manned (cargo) elevators, escalators and moving sidewalks. The specific scope is determined according to the catalogue of special equipment stipulated by the state. Article 3 The municipal, county-level city and district people's governments shall strengthen their leadership over elevator safety supervision and management, incorporate elevator safety supervision and management into the assessment of government safety responsibilities, urge relevant departments to perform their duties of elevator safety supervision and management according to law, establish a coordination mechanism for elevator safety management, coordinate and solve major problems in elevator safety supervision and management in a timely manner, and incorporate elevator safety supervision and management funds into the financial budget.
Town people's government, street offices, development zones (parks) management agencies shall cooperate and assist in elevator safety supervision and management. Article 4 The market supervision and management department shall be responsible for the supervision and management of elevator safety within its administrative area.
Development and reform, education, industry and information technology, public security, housing and urban construction, transportation, commerce, culture and tourism, health and emergency management departments shall, according to their respective responsibilities, do a good job in elevator safety supervision and management. Article 5 Units that produce, use and maintain elevators and inspection and testing institutions engaged in corresponding activities shall abide by the requirements of laws, regulations, safety technical specifications and standards, and be responsible for elevator safety in their production, use, maintenance, inspection and testing. Article 6 The market supervision and management department shall strengthen the publicity and education of elevator safety laws and regulations, popularize elevator safety knowledge, and enhance the public's elevator safety awareness and self-protection ability.
Organs, organizations, enterprises and institutions, and village (neighborhood) committees shall publicize and popularize elevator safety knowledge and advocate civilized use of elevators.
Kindergartens and schools should take elevator safety knowledge as an important part of safety education, and cultivate the habit of safe and civilized use of elevators for children and students.
The news media should publicize the elevator safety for public welfare and guide the public to use the elevator correctly. Article 7 Encourage the adoption of new technologies and methods such as big data and Internet of Things, promote the intelligent and informational development of elevator production, use, maintenance, inspection and testing, emergency response and supervision and management, and improve the level of elevator safety management. Article 8 Elevator manufacturers, users and maintenance units are encouraged to take out elevator safety liability insurance separately or jointly.
Promote elevator safety liability insurance for elevators in schools, medical institutions, stations, shopping malls and other public gathering places. Article 9 The elevator industry association shall strengthen the self-discipline management of the industry, formulate industry service standards, participate in the formulation of relevant standards, promote the construction of industry credit system, and promote the orderly competition and standardized operation of the industry. Chapter II Selection, Configuration and Production Article 10 The selection and configuration of elevators shall be adapted to the building structure and use requirements, in line with relevant national and provincial regulations and standards, and ensure rescue and barrier-free access.
Newly installed escalators and moving sidewalks such as stations, airports, passenger terminals, rail transit stations and pedestrian crossing facilities. Public transport elevators that meet the standards shall be equipped in accordance with the relevant provisions of the state.
When installing elevators in construction projects using fiscal funds, the safety performance, failure rate, after-sales service and credit status of elevator manufacturers and sales units shall be included in the evaluation scope of procurement or bidding. Eleventh new construction, renovation and expansion projects, the construction unit shall entrust a qualified unit, in accordance with the requirements of laws, regulations and safety technical specifications, elevator shaft, pit, machine room and landing design, construction and supervision. The anti-leakage warranty period of elevator civil engineering is not less than five years, counting from the date when the project is completed and accepted.
When elevators are added to existing houses, civil buildings shall meet the engineering quality requirements, and the anti-leakage warranty period shall comply with the provisions of the preceding paragraph. Twelfth elevator manufacturing units responsible for product quality, should be responsible for the safety performance of the elevator, and fulfill the following obligations:
(a) to provide technical guidance and services necessary for the safe operation of the elevator, and to assist in troubleshooting the elevator;
(2) Track, investigate and understand the safe operation and maintenance of elevators, and put forward improvement suggestions for existing problems;
(3) If the elevator has signs that endanger safety due to design and manufacture, it shall immediately stop manufacturing and take the initiative to recall, inform the users in time and report to the market supervision and management department;
(four) other obligations stipulated by laws, regulations and safety technical specifications.
Elevator manufacturing units shall not use any technical means to limit the normal maintenance of elevators, which will affect the safe operation of elevators. Article 13 If a production enterprise sells elevators made abroad in this city and has not set up a direct sales agency in China, it shall designate an agent registered in China, and the agent may first assume the safety responsibilities of the elevator production enterprise as stipulated by laws and regulations.
