Legal analysis: if the guarantor still has property after his death, he shall bear the responsibility of guarantee. In essence, guarantee should belong to the debt paid by conditional money, and it has no personal specificity. Except for the property with personal specificity, it can be inherited in principle. Inheriting an estate shall pay off the taxes and debts payable by the decedent according to law, and the payment of taxes and debts shall be limited to the actual value of the estate. The death of the guarantor does not mean that the guarantor's credit is shattered, and the guarantor's credit is directly related to the guarantor's solvency. If the guarantor leaves a legacy after his death, he shall still bear the guarantee responsibility with his legacy.

Article 147 An estate administrator shall perform the following duties:

Article 162 The execution of a legacy shall not prevent the legator from paying off taxes and debts according to law.

Article 163 If there are both statutory inheritance and testamentary inheritance and bequest, the legal heir shall pay off the taxes and debts that the decedent should pay according to law; The part exceeding the actual value of the statutory inheritance shall be paid off by the testator and legatee in proportion to the income.
