Apply for an export license
The export license is a legally binding document approved by the state administrative department of foreign trade and economic cooperation on behalf of the state for the export of a commodity, and it is also the basis for the customs to examine and release the exported goods and the banks to handle foreign exchange settlement.
The basic procedures for applying for an export license are:

That is, the applicant entity or individual (hereinafter referred to as "witness") submits a written application letter to the issuing authority.
The contents of the application include: the name, specification, country and region of export commodities (goods), quantity, unit price, total amount, delivery date, payment method (that is, export foreign exchange collection method) and other items. At the same time, relevant certificates or materials must be submitted to the issuing authority;
The foreign trade company shall present the original (or copy) of the contract; Non-foreign trade units shall be approved by the competent department (department or bureau level). Cultural relics, with materials approved by the competent department of cultural relics; Books and periodicals shall be approved by the competent publishing department; Celebrity calligraphy and painting (modern only), approved by the Ministry of Culture; Gold and silver (excluding ornaments), approved by the head office of China People's Bank; Patents, proprietary technologies and traditional skills must be approved by the State Patent Office or the competent department; Residents or villagers can leave the country only after going through the relevant formalities with the certificate letter and purchase invoice issued by the sub-district office or the villagers' committee. In any of the following circumstances, relevant certificates or materials shall also be provided:
(1) When a foreign trade enterprise that has been approved to enjoy the right to export business applies for an export license from the issuing authority for the first time, it shall submit a set of copies of the approval document of the competent department for the establishment of the company (enterprise), the articles of association of the company (enterprise), the business license, the catalogue of export commodities, etc.
(2) When an approved foreign-invested enterprise applies for an export license to the license issuing agency for the first time, it shall submit a set of approval documents of relevant departments on the project contract, business license and a copy of the annual export plan approved by MOFTEC.
Check and fill in the form
After receiving the above-mentioned relevant application materials, the issuing authority shall examine them. After approval, the witness shall fill in the People's Republic of China (PRC) Export License Application Form as required.
Input computer
The completed application form for export license shall be stamped with the official seal of the applicant and sent to the license issuing agency. If it meets the requirements after examination, the issuing authority shall input the contents of the application form into the computer.
Issue a license
The license issuing agency shall issue the People's Republic of China (PRC) Export License in quadruplicate within three working days after the application form is sent, and submit the first, second and third copies to the witness, so as to go through the formalities of goods export declaration and bank settlement with the customs. Documents and materials required to apply for an export license
(1) General documents and materials that all kinds of import and export enterprises should provide to the license issuing agencies when applying for export licenses:
Application form for export license. The application form (original) should be clearly filled in and stamped with the official seal of the applicant. Fill in the content must be standardized;
Export contract (original);
The applicant's official letter or the applicant's work permit; The agent shall issue a power of attorney from the entrusting unit;
Non-foreign trade units (referring to all organs, organizations, enterprises and institutions without the right to operate foreign trade, the same below) need to provide proof from their competent departments (bureau level or above) when applying for export licenses;
An applicant applying for an export license for the first time shall provide a document (copy of the original) approved by the Ministry of Foreign Trade and Economic Cooperation or its authorized local foreign trade department for the import and export operation right of the enterprise;
When applying for an export license for the first time, a foreign-invested enterprise shall provide the approval certificate and business license (copy) approved by the competent government department, which shall be filed by the issuing authority.
(2) For export under general trade, the following materials shall be submitted respectively:
For commodities subject to quota management, all kinds of import and export enterprises of the state ministries and commissions shall submit the approval documents of the export quota examination and approval department of the Ministry of Foreign Trade and Economic Cooperation, and all kinds of import and export enterprises in various places shall submit the approval documents of the local foreign trade and economic cooperation department.
If it belongs to general chemicals for military and civilian use, the approval document of the Ministry of Chemical Industry shall be submitted;
Precursor chemicals should be reported to MOFTEC for approval;
Heavy water must be reported to the Ministry of Foreign Trade and Economic Cooperation for approval;
Computers should be submitted to the export computer technology review form approved by MOFTEC.
For commodities subject to paid quota bidding, the export license certificate for commodities subject to paid quota bidding issued by the relevant bidding committee shall be submitted; For goods subject to free bidding, the bid-winning certificate issued by the relevant bidding committee shall be submitted.
(3) When contracted projects bring out commodities (commodities subject to quota paid bidding shall be handled according to the relevant provisions of bidding), import and export enterprises of various ministries and commissions of the state shall submit the project approval documents of the Ministry of Foreign Trade and Economic Cooperation and the contract of the exporting unit; All kinds of import and export enterprises in various places shall submit the project approval documents of the local foreign trade authorities and the contracts of the exporting units. The export contract shall specify the types and quantities of licensed commodities brought out from the contracted projects.
(four) all kinds of import and export enterprises of various ministries and commissions of the state shall submit the export quota documents and import and export processing documents approved by the Ministry of Foreign Trade and Economic Cooperation; All kinds of import and export enterprises in various places shall submit export quotas and processing documents approved by local foreign trade authorities. For the re-export goods that are not processed by self-use quotas, all kinds of import and export enterprises of the state ministries and commissions shall submit the approval documents of the Ministry of Foreign Trade and Economic Cooperation and the Registration Manual for Feed Processing. When steel, pig iron, zinc, sugar and other commodities are re-exported, all kinds of import and export enterprises in China should submit the approval documents of the Ministry of Foreign Trade and Economic Cooperation and the registration manual for feed processing.
(5) Documents and materials to be submitted for non-trade export:
Transport samples.
When a non-foreign trade unit exports samples, if the value of each batch of samples is higher than RMB5,000 and not more than RMB654.38+RMB0,000, it shall submit an official letter issued by the competent department at a higher level (above the bureau level).
If the value of each batch of samples is higher than 5000 yuan, all kinds of import and export enterprises shall apply for export licenses in accordance with the general trade management regulations.
Exhibit transportation.
Articles brought by exhibitions held abroad by non-foreign trade units that need to be sold abroad or not brought back to China after the exhibition must be reported to the Ministry of Foreign Trade and Economic Cooperation for approval.
Articles sold overseas by the directly affiliated head office authorized by the Ministry of Foreign Trade and Economic Cooperation are licensed commodities, and the approval documents for holding exhibitions approved by the Ministry of Foreign Trade and Economic Cooperation shall be submitted.
Specification for content of export license application form
Units applying for export licenses shall fill in the application form for export licenses in accordance with the following requirements.
(1) Exporter:
For export commodities subject to quota management, the full name of the import and export enterprise of the export quota unit shall be filled in;
For export commodities subject to general license management, the full names of various import and export enterprises with export rights shall be filled in;
The full name of the agency that has the right to operate the export shall be filled in for the repayment of loans and the export of compensation trade items;
Non-foreign trade units are approved to ship goods, and the name of the unit should be filled in this column;
The enterprise code shall be filled in according to the code compiled by the license issuing agency authorized by MOFTEC (the same below).
(2) The entrusting party:
The consignor and exporter of commodities subject to quota bidding (including paid bidding and free bidding) must be consistent;
Shippers of other commodities subject to export quota management should be consistent with exporters in principle, but they may also be inconsistent with exporters.
When repaying export loans, compensation trade exports and foreign-invested enterprises entrust agents to export, and lenders and exporters may be inconsistent.
(3) Export license number: arranged by the license issuing agency.
(4) The validity period of the export license:
For commodities subject to the "one batch, one license" system, the license is valid for a maximum of three months from the date of issuance. The validity period of the Permit for Fresh and Frozen Commodities for Hong Kong and Macao (excluding re-export) is one month.
For commodities, foreign-invested enterprises and export commodities under compensation trade that do not implement the "one batch, one license" system, the validity period of their licenses is up to 6 months from the date of issuance.
If the validity of the license is required to span different years, the date of the license can be filled in the next year, at the latest by the end of February.
(5) Mode of trade:
The contents of this column include: general trade, barter trade, compensation trade, processing of incoming materials, processing of incoming materials, export of foreign-invested enterprises, border trade, processing of outgoing materials, entrepot trade, futures trade, contracted projects, loan repayment export, international exhibitions, agreement trade and other trade.
Feed processing re-exports, fill in this column for feed processing.
When the raw materials of foreign-invested enterprises are re-exported, it should be filled in that the foreign-invested enterprises export by trade.
If the value of each batch of goods and samples shipped by non-foreign trade units exceeds 5,000 yuan, fill in "International Exhibition" in this column.
All kinds of import and export enterprises export exhibition products, this column is filled with "international exhibition", and the export samples are filled with general trade.
(6) Contract number:
Refers to the export contract code used for applying for license, customs declaration and foreign exchange settlement.
For crude oil, refined oil and non-trade exports, contract numbers are not required.
When the exhibits are shipped, the document number approved by MOFTEC shall be filled in this column.
(7) Port of declaration:
Indicate the port of shipment. This column allows you to fill in three ports, but you can only declare at one port.
(8) importing country (region):
Refers to the final destination, that is, the contract destination, where the domain name (such as Europe, etc.). ) is not allowed to be used.
(9) Payment method:
This column includes: letter of credit, collection, remittance, promissory note, cash, accounting and free of charge.
(10) mode of transportation: sea transportation, railway transportation, road transportation, air transportation, postal transportation and fixed transportation can be filled in.
(11) Commodity name and code: according to the standard name in the Catalogue of Commodities Subject to Export License Administration issued by the Ministry of Foreign Trade and Economic Cooperation.
(12) specifications and grades:
Specification and grade column, used to specify goods, including specific varieties and specifications (such as cement grade, steel grade, etc.). ) and grade (such as rabbit hair grade). When there are more than four specifications and models of the same coded commodity, an export license application form shall be filled out separately. "Labor export materials" should also be filled in accordingly.
The goods shipped must be consistent with the varieties, specifications or grades of the goods listed in this column.
(13) Unit: refers to the unit of measurement. For export commodities under non-trade, the unit of measurement in this column is "batch", and the specific unit is indicated in the remarks column.
(14) Quantity, unit price and total price:
Quantity means the quantity of goods allowed to be exported in this credit. This value allows one decimal place to be reserved, and all numbers exceeding this value should be rounded off. If the UOM is batch, this column is 1.
Unit price refers to the unit price consistent with the unit of measurement. If the UOM is Batch, this column is the total amount.
(15) Remarks: Fill in the unfinished items in the above columns.
Handling of alteration, extension and loss of export license
( 1)
When all kinds of import and export enterprises need to change or extend the export license for some reason after obtaining the license, they should handle it according to the following provisions.
Once the export license is issued in accordance with the regulations, no license issuing agency may change any content of the license; If it is really necessary to change the project, the exporting unit shall fill in the application form for export license and provide the export contract, and submit the original export license, which will be renewed by the issuing authority.
If the export license is not used or used up within the validity period, the exporter may apply for an extension and return the original export license to the original license issuing agency. The original issuing authority shall reissue the unused license in accordance with the regulations. The validity of the export license can be extended to the end of February next year at the latest.
(2) If the applicant loses the export license, it shall report the loss to the license issuing agency and the customs at the port where the license is declared. When reapplying for an export license, the license issuing agency shall be provided with the undeclared certificate and the report of loss reporting, and the license issuing agency shall handle it according to the regulations.
Legal liability of the applicant
Applicants are not allowed to forge, alter or buy or sell export licenses, and offenders will be investigated for criminal responsibility according to the Foreign Trade Law of People's Republic of China (PRC) and customs regulations.
