Property preservation before litigation shall meet the following conditions:
1. The creditor's rights put forward by the applicant after property preservation have the content of property payment;
2. In case of emergency, failure to take corresponding preservation measures immediately may cause irreparable losses to the legitimate rights and interests of the applicant;
3. The interested party applies for pre-litigation property preservation;
4. The applicant must provide a guarantee. If the applicant fails to provide a guarantee, the people's court shall reject the application for property preservation filed by the applicant before the prosecution.
To sum up, applying for pre-litigation property preservation is similar to going to court. You can apply before the prosecution, or you can apply together at the time of prosecution.

If an interested party fails to apply for preservation immediately due to an emergency, which will cause irreparable damage to its legitimate rights and interests, it may apply to the place where the preserved property is located, the domicile of the respondent or the people's court with jurisdiction for preservation measures before bringing a lawsuit or applying for arbitration. The applicant shall provide a guarantee. If no guarantee is provided, the application shall be rejected. After accepting the application, the people's court must make a ruling within 48 hours; Where protective measures are ordered, they shall be implemented immediately. If the applicant fails to bring a lawsuit or apply for arbitration according to law within 30 days after the people's court takes the preservation measures, the people's court shall lift the preservation.
