Detailed Rules for the Implementation of the Provisional Regulations on the Registration of Real Estate
Article 70 Under any of the following circumstances, the parties may apply for cancellation of mortgage registration with real estate registration certificate, mortgage cancellation materials and other necessary materials:
(1) The principal creditor's rights are extinguished.
(2) The mortgage right has been realized;
(3) The mortgagee waives the mortgage right;
(4) Other circumstances in which the mortgage right is extinguished as stipulated by laws and administrative regulations.
Article 77 Where the housing mortgages under construction is changed, transferred or destroyed, the parties concerned shall submit the following materials when applying for registration of change, transfer or cancellation:
(1) Real estate registration certificate;
(two) materials changed, transferred or destroyed in housing mortgages under construction;
(3) Other necessary materials.
When the house under construction is completed and the ownership of the house is registered for the first time, the parties concerned shall apply for changing the mortgage registration of the house under construction into the mortgage registration of the house.
