The fund shall be managed at different levels, independently accounted for and used with compensation. The Ministry of Environmental Protection opened a special fund account for pollution source control in the bank (hereinafter referred to as the "special fund account"), deposited it in the special account, and entrusted the bank to handle special fund loans (hereinafter referred to as "loans").
The environmental protection department entrusts the bank to handle the deposit and loan business, which shall be handled in accordance with the relevant provisions of the People's Bank of China. Article 3 The Municipal Environmental Protection Bureau is the competent department in charge of unified supervision and management of the use of funds. Article 4 These Measures shall apply to the administrative areas of this Municipality. Chapter II Sources of Funds and Conditions of Use Article 5 The funds shall come from the following funds:
(a) according to the Interim Measures for the Collection of Sewage Charges in the State Council, the excessive sewage charges are used to subsidize key pollutant discharge units to control pollution sources;
(two) according to the "measures for the implementation of the collection of sewage charges in Shandong Province", sewage charges are used to subsidize key pollutant discharge units to control pollution sources;
(three) in accordance with the provisions of the "Regulations on the Administration of Environmental Noise in Qingdao", the cost of environmental noise pollution shall be used to subsidize key pollutant discharge units to control pollution sources;
(4) Loan interest income and penalty interest income;
(5) Other funds. Sixth special fund loans for enterprises and institutions to pay sewage charges. Article 7 The scope of use of the fund is:
(a) the key pollution source control projects determined by the people's governments at all levels;
(two) pollution source control projects that are strongly reflected by the public and seriously disturb the people;
(3) Comprehensive utilization project of "three wastes";
(four) pollution source control projects or demonstration projects with typical significance for solving regional or industrial pollution;
(5) Pollution source control facilities of enterprises that merge, relocate or relocate in order to solve pollution;
(6) Pollution source control projects in technological transformation projects;
(seven) pollution source control research projects. Article 8 Enterprises and institutions that meet the following conditions may apply to the Ministry of Environmental Protection for loans with special funds:
(a) to pay sewage charges in accordance with the provisions;
(2) The pollution source control project has passed the feasibility study. Practicable and approved by relevant departments;
(3) Self-raised funds account for more than 30% of the total investment;
(4) It has the ability to repay the loan and is guaranteed by the competent department or a legal person institution with repayment ability. Article 9 Enterprises and institutions that meet the conditions as stipulated in Article 8 of these Measures shall be given priority in loans if their pollution source control projects are under any of the following circumstances:
(a) the deadline set by the people's governments at all levels;
(two) serious pollution, which is in urgent need of treatment;
(3) Located in residential areas, cultural and educational areas, water source protection areas, scenic spots and convalescent areas;
(4) Self-raised funds account for more than 60% of the total investment;
(five) short construction period, quick effect, remarkable economic and environmental benefits. Chapter III Loan Procedures Article 10 Enterprises and institutions applying for loans (hereinafter referred to as loan units) shall submit pollution source control plans for the next year to the environmental protection department before the end of each year 1 1.
(a) the loan units in Shinan District, Shibei District, Taitung District, sifang district and Cangkou District shall submit pollution control plans according to the following procedures:
1. central and provincial loan units, reported to the municipal environmental protection department;
2 municipal loan units, after the audit summary by the competent department, reported to the municipal environmental protection department;
3 loan units below the district level shall be audited and summarized by the district environmental protection department and reported to the municipal environmental protection department by the competent department.
(two) counties (cities) and Laoshan District, Huangdao District loan units respectively according to the following procedures to submit pollution control plans:
1. The central, provincial and municipal units shall report to the county (city) and district environmental protection departments;
2 county (city) district belongs to the following loan units, which shall be reviewed and summarized by the competent department and submitted to the environmental protection department of the county (city) district. Eleventh loan units according to the submitted annual pollution control plan, in February, July and September each year, the pollution control project plan and related documents, repayment plans and measures, respectively, according to the procedures of Article 10 of these measures for examination and approval.
The pollution source control project scheme of the loan unit below the municipal level shall be reviewed and demonstrated by the competent department, and the leading opinions shall be submitted to the environmental protection department. Article 12 After reviewing the reported pollution source control plan, control scheme, repayment plan and measures, the environmental protection department will make a comprehensive balance with the relevant departments such as planning and finance, and issue a "paid use plan for special funds for pollution source control" according to the annual investment plan. According to the plan, the financial department will allocate the sewage charges remitted to the warehouse to the "special fund account" on a quarterly basis.
The environmental protection departments of counties (cities), Laoshan District and Huangdao District shall, within one month after the release, report to the municipal environmental protection department for the record.
