Legal analysis: may be cheated. Internet fraud will be filed regardless of the amount. If the amount is less than 3,000 yuan, it does not constitute fraud. However, those who violate social security shall be detained for not less than five days but not more than ten days and fined not more than 500 yuan. If the accumulated amount of fraud exceeds 3000 yuan to 10000 yuan, criminal responsibility may be investigated for fraud.

Article 266 Whoever defrauds public or private property in a relatively large amount shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention or public surveillance, and shall also or solely be sentenced to fixed-term imprisonment of not less than three years but not more than 10 years, and shall also be sentenced to fixed-term imprisonment of not less than 10 years or life imprisonment, and shall also be fined or confiscated.
