Chapter I General Principles

Article 1 In order to do a good job in the work of the National Development Bank's student-origin credit loan in Qinghai Province, according to the Opinions of the State Council on Establishing and Perfecting the Financial Aid Policy System for Students with Financial Difficulties in Higher Vocational Schools and Secondary Vocational Schools (Guo Fa [2007] 13) and the Notice of the Ministry of Finance, the Ministry of Education and the China Development Bank on Piloting Student-origin Credit Loan in Some Areas (Cai Jiao [2007]), 135), Guiding Opinions of China Development Bank on National Student Loans, and Notice of Xining Central Branch of Qinghai Provincial Department of Education on Doing a Good Job in Student Credit Student Loans (No.53 [2008] of Qing Jiao Zong) are formulated in this way.

Article 2 The Provincial Department of Education is the lead unit in the work of student-origin credit student loans in Qinghai Province, and the Qinghai Provincial Student Financial Assistance Management Office (hereinafter referred to as the Provincial Financial Assistance Office) is responsible for organizing, coordinating and managing the work of student-origin credit student loans, guiding the state (prefecture, city) and county (city, district) education bureaus to establish and improve student financial assistance management centers, and organizing, guiding, assessing and supervising the county-level student financial assistance management centers to carry out loan management and principal and interest collection; Responsible for applying for and collecting financial discount funds and risk compensation for student-origin credit student loans, and transferring them to the special account of the undertaking bank in full and on time; Relying on the personal credit inquiry function of the credit information system of China People's Bank, we will establish and strengthen the personal information management of student-origin credit student loans.

Article 3 Qinghai Branch of China Development Bank shall, according to the national credit policy, scientifically and reasonably design the loan method and term structure, formulate the operating rules for student-origin credit student loans, be responsible for the examination, issuance and management of loans, ensure smooth loan channels, and enable eligible students with financial difficulties who need loans to apply for student-origin credit student loans. In conjunction with the Provincial Department of Education and the Provincial Department of Finance, according to the characteristics of different stages of the student-origin credit loan commitment cycle, loan products, information and credit links between student-centered families, universities and employment units will be established to form credit management in the whole process of student loans.

Article 4 The education administrative departments of each state (prefecture, city) and county (city, district) shall set up a student financial aid management center with legal personality (hereinafter referred to as the state financial aid center and county financial aid center), equipped with corresponding full-time personnel, and specifically organize and implement the work of student-origin credit student loans in this region. The state aid center is mainly responsible for the statistical summary, supervision and inspection of the loan work in this area. The county-level funding center is responsible for organizing the publicity and education of student-origin credit student loans; Responsible for collecting, sorting out and summarizing the family economic status of freshmen and students in the county (city, district) before enrollment, and the demand for credit student loans from their places of origin; Investigate and identify the family financial difficulties of students applying for loans; Establish a student credit and loan qualification evaluation team, determine the list of students who meet the loan conditions, calculate the loan demand, and prepare the loan plan; Responsible for accepting student loan applications, reviewing and signing contracts, and submitting them to the Provincial Student Aid Office for the record as required; Responsible for the accounting of financial discount funds and risk compensation amount in conjunction with the agent bank, and timely report to the Provincial Aid Office; According to the requirements of unified format, formulate corresponding post-loan management measures and establish loan student management ledger; Responsible for the post-loan management of student-origin credit student loans, and timely collect the loan principal and interest.

Article 5 The correspondent bank is entrusted by the undertaking bank to assist in the settlement management of the credit student loan business of the county (city, district). The county student aid center will open a settlement account for students' credit student loan funds (hereinafter referred to as the settlement account) for the issuance of students' credit student loan funds and the collection of loan principal and interest; Open a student-origin credit student loan personal account (hereinafter referred to as personal account) for borrowing students, which is used for the issuance of student-origin credit student loan funds and the recovery of principal and interest.

The agent bank is responsible for supervising the funds in the settlement account opened by the county rescue center. When granting loans to borrowing students, the funds in the account shall not be transferred to other accounts other than the personal account designated by the borrowing students; When the loan is recovered, the collected principal and interest recovery funds shall not be transferred to any account other than the deposit account opened by the Qinghai Provincial Student Financial Assistance Management Office in the Development Bank.

Sixth ordinary high schools should cooperate with the county funding center and the undertaking bank to provide students with the enrollment situation of the college entrance examination in that year and the demand for credit student loans from the students' places of origin, and assist in the application, approval and issuance of loans. Colleges and universities should strengthen the honesty education for students, cultivate their honesty consciousness, and urge them to fulfill their repayment obligations according to the contract after graduation; According to the needs of the county financial aid center, assist in providing relevant information of students with student-origin credit student loans, and fill in the Receipt of Student-origin Credit Student Loans in time; Establish loan student files, fill in the monthly report of loan students on time, and timely summarize and input the relevant information of loan graduates on the "National Student Loan Information System"; Strengthen communication with the county rescue center to avoid repeated loans.

Chapter II Loan Objects and Conditions

Seventh students from poor families who take the national unified entrance examination for ordinary colleges and universities can apply for student-origin credit loan in the county (city, district) financial aid center where their household registration is located.

Article 8 Students and families applying for student-origin credit student loans shall meet the following conditions:

(a) students who apply for student credit loans must meet the following conditions:

1. has the nationality of the people of China;

2. Have full capacity for civil conduct;

3. Honest and trustworthy, law-abiding;

4. According to the relevant provisions of the state, it is approved to set up full-time undergraduate colleges, higher vocational schools and colleges (including private colleges and independent colleges) to formally admit freshmen or college students, and obtain a true, legal and effective admission notice;

5. The student's household registration and family residence are in the county. In principle, middle schools should also be in the county, and with the consent of the county education department, they can also enroll students across counties;

6. The family is in financial difficulties, and the income they can get is not enough to cover the basic expenses needed to complete their studies at school.

(2) Students' families who apply for student loans must meet the following conditions:

1. No bad credit record;

2. Parents or other legal guardians of students are registered in this county;

3. Family financial difficulties meet one of the following characteristics. The total income is not enough to cover the basic expenses for students to complete their studies during their school days;

(1) poverty-stricken households and urban low-income households in agricultural and pastoral areas;

(2) Families of orphans and disabled persons;

(3) Suffering from natural and man-made disasters, causing heavy losses and unable to afford the students' expenses;

(4) Family members suffering from serious diseases;

(5) The creator of the main income of the family loses the ability to work for some reason;

(6) Single-parent families with no stable income;

(7) Families where one or both parents are unemployed;

(8) Other poor families.

Chapter III Loan Amount, Term and Interest Rate

Article 9 The maximum amount of student-origin credit loan of China Development Bank is 6,000 yuan per person per academic year. The specific amount is determined according to the tuition and accommodation fees of the school where the students attend and the poverty level of the family. It is mainly used for tuition and accommodation during school, and can be partly used for living expenses. Apply for a loan once a year and sign a loan contract once a year. According to the school receipt (attachment 1) filled in and sealed by the school in that year, the loan will be issued.

Article 10 The loan term shall be determined in principle according to the academic system required by the borrower for normal graduation plus 65,438+00 years, and the longest period shall not exceed 65,438+04 years. Borrowing students who have studied for more than 4 years and continue to pursue a higher degree (including the second bachelor's degree) will shorten the period of repayment of principal and interest after graduation. Unless there are special circumstances, in principle, it will not be extended.

Article 11 The loan interest rate shall be based on the benchmark interest rate of the same period and grade published by the People's Bank of China at the time of loan issuance, with a fixed term of one year.

Twelfth loan interest is charged annually; During the period of school, the interest of borrowing students is fully discounted by the finance; After graduation, the interest will be paid by the borrower, starting from September 1 day of the graduation year. There is a grace period for students and two years after graduation. Upon the expiration of the grace period, the loan principal will be repaid in installments from the second year after graduation (65438+February 2 1), and all loans will be paid off at the end of the loan period. Early repayment is encouraged, and no extra fees are charged except the principal and interest payable.

Chapter IV Loan Procedures and Requirements

Article 13 Application for loan

Under the guidance of the county student aid center, ordinary high schools in the province begin to publicize the student-origin credit student loan policy to the graduating students every April. Students who want to continue their studies and need loans should fill in the pre-application form for student-origin credit loan (Annex 2. 1. This form is supplemented and modified by the county funding center according to the needs), and the loan pre-application is made to the middle school where it is located. Each middle school takes the class as a unit and puts forward a list of poor students who meet the loan conditions according to the loan objects and conditions. After publicity and audit in the school, the list of students to be loaned and the performance certificate during the school period will be submitted to the county financial aid center.

After receiving the formal admission notice, the students who intend to borrow will formally apply to the county financial aid center and fill in the Unified Application Form for Student-origin Credit Student Loan of Qinghai Branch of China Development Bank (Annex 2.2). Please fill in Appendix 2.3) and provide the following supporting materials:

1. The borrower and the legal and valid identity certificates of the borrower and their copies;

2. The detailed address and contact information of the registered permanent residence;

3. Student identification. Freshmen with university admission notice and its copy; Students who are studying should show their student ID card and the certificate issued by the university where the borrower is located that I have not obtained the national student loan in this university.

4. According to the detailed list of college fees issued by freshmen, the certificate of tuition and accommodation fees issued by the county funding center, and the certificate of national student loan issued by the university funding center for this academic year, all apply for loans in integer multiples of 500 yuan, and the loan amount shall not be arbitrarily increased.

Article 14 loan review and contract signing

County (city, district) township government (street office) and village committee (community) carefully verify the students' family situation, and sign the audit opinion on the loan application form. The county aid center examines the application materials and signs contracts with the students and borrowers who have passed the examination in time.

This contract is made in quadruplicate, two of which are kept by the Center, one is filed, and the other is returned to the Development Bank after being sent back to the Center. Borrowing students and * * * borrowers each keep one copy. After the signing of the contract, the county student aid center will transfer the relevant information to the agent bank on the same day to open a personal account for the borrowing students (for issuing loan funds and recovering principal and interest).

Article 15 Acceptance of the Contract

Borrowing students report to the school with the certificate and receipt issued by the county financial aid center. The school fills in the receipt and seals it according to the receipt requirements, and the borrower will send the sealed receipt back to the local county financial aid center within 20 days after arriving at the school. County funding center to sort out loan contracts and receipts, summary report to the provincial funding office, the provincial funding office submitted to the development bank for approval.

Article 16 loan approval

1. The provincial financial aid office shall submit the details of the loan amount to be issued to the branch for approval within 10 working days before the planned issuance date.

2. The Development Bank shall examine and approve the loan application submitted by the Provincial Aid Office within 5 working days after receiving it, and the loan contract shall take effect after being examined and approved by the Development Bank.

3. The Development Bank will summarize the examination and approval results and send them to the Provincial Aid Office. After receiving the examination and approval results, the Provincial Rescue Office will send it to the county rescue center, which will forward it to the agency for the record.

Article 17 Loan issuance

1. According to the examination and approval opinions of the Development Bank, the Provincial Aid Office applies for fund transfer. The Development Bank issues loans to the special account opened by the Provincial Aid Office in the Development Bank, and the Provincial Aid Office transfers the loan funds from the special account to the settlement account opened by the County Aid Office in the agent bank on the day of loan issuance.

2. The correspondent bank will transfer the loan funds from the settlement account to the borrower's personal account on the day when the loan funds arrive. After verification, it will be recorded in batches within 3 days at the latest, and the transfer voucher will be submitted to the county funding center, which will summarize and file it.

3. The agent bank shall transfer the loan funds from the personal account to the borrower's school account within 5 days from the date when the loan funds are transferred from the settlement account to the borrower's personal account according to the Summary of Lending Instructions of the County Rescue Center (Annex 3).

After the loan disbursement is completed, the agent bank shall, within 5 working days (postponed on holidays), affix its official seal on the Loan Remittance Summary Table (Annex 4) and submit it to the county assistance center, and at the same time submit electronic documents and paper documents.

Eighteenth principal and interest recovery

(1) Repaying loan interest

Interest on student loans is calculated on an annual basis. The interest settlement date is 65438+ February 20th every year, and the value date is the date when the loan funds are transferred to the borrower's personal account. The annual interest payment date is 65438+February 2 1 (the last year of the loan is August 3 1 of the current year), and the interest will be paid off with the principal at the last repayment. During the loan period, according to the relevant regulations of student-origin credit student loan, the borrower will enjoy full financial discount from the time of student loan issuance to August 3 1 day of graduation year. The borrower shall bear the loan interest on its own from September 1 day of the graduation year, and deposit the repayable loan interest into the personal account before the 5 th day of the annual interest payment date, and the agent bank will collect it from the account.

1. Interest recovery of students who borrowed money during school.

The agent bank shall prepay the interest 30 working days before the annual interest settlement date (65438+February 20th), and the county funding center shall report the prepayment information to the provincial funding office for summary, and the provincial funding shall report it to the Development Bank for review and confirmation. After the confirmation of the development bank, the provincial aid office shall apply to the competent department for discount.

The discount interest funds undertaken by the central finance shall be transferred and paid in accordance with the relevant provisions of the central finance; The provincial financial burden of discount interest funds collected by the provincial aid office, directly allocated to the development bank before the interest settlement.

After receiving the financial discount funds, the development bank shall notify the agent bank in writing to handle the accounts.

2. Recovery of loan principal and interest after graduation.

According to the deduction instruction summary table (Annex 5), the county financial aid center checks the loan student list, loan amount, term, interest rate and other information with the agent bank before the loan principal and interest expires, and the agent bank calculates the principal and interest amount. The county rescue center shall notify the borrowing students and borrowers in advance to deposit the corresponding funds into their personal accounts. According to the deduction instruction, the agent bank will deduct the principal and interest of the loan from the student's personal account and transfer it to the settlement account of the county aid center. Transfer the money to the repayment account opened by the Qinghai Provincial Student Financial Assistance Management Office in the Development Bank within 5 days. After the transfer is completed, the agent bank shall issue settlement documents and loan deduction summary tables to the county funding center within 5 working days, and submit electronic documents and paper documents at the same time.

(2) Repaying the loan principal

According to the credit loan policy of students' origin, the loan principal is repaid once a year in the form of equal principal repayment. The borrower shall repay the loan principal from 65438+February 2 1 of the current year after the grace period (2 years) ends, and repay the last principal in the last year of the loan term.

The fixed repayment date is 65438+February 2 1 each year (the last year of the loan is August 3 1 of that year). During the loan period, the Borrower shall strictly implement the repayment plan under this Contract, and deposit the repayable loan principal into the personal account before the 5th day of repayment every year, and the agent bank will collect it from the account.

The county funding center will collect and file the relevant settlement documents and deduction list provided by the agent bank, and report the relevant summary table to the provincial funding office for summary, and then the provincial funding office will submit it to the development bank.

Chapter V Early Repayment

Article 19 June 20th of each year is a fixed prepayment date. If the borrower needs to prepay, he shall submit a written application to the county financial aid management center 30 days in advance (Application for Prepayment of Student Loan of China Development Bank (Annex 7)). The loan principal repaid in advance must be an integral multiple of 500 yuan or paid off in one lump sum. The interest on the prepayment part is calculated according to the interest rate agreed in the contract and the actual service life, and no other fees are charged except the interest payable. The remaining loan amount after prepayment is still repaid according to the average capital method.

Chapter VI Change of Contract

Twentieth when the borrower's designated account changes, it shall timely apply to the county financing center for loan change procedures, and the county financing center shall report to the Development Bank for approval. Because the information was not changed in time, all the responsibilities were borne by the borrowing students.

Article 21 When a borrower needs to adjust the repayment plan for continuing to study for a degree after graduation, he should apply to the Development Bank through the county funding center that applied for the loan 30 days before graduation. With the consent of the Development Bank, the grace period can be extended, and the original loan period remains unchanged.

Borrowing students who have obtained a master's degree (or a second bachelor's degree) after graduating from a university (or college) but have not paid off the loan principal under this contract shall notify the development bank and the correspondent bank within 15 days after receiving the notice of admission of a master's degree (or a second bachelor's degree), and go through the formalities for changing this contract in person and repay the principal and interest according to the changed loan contract. If the borrower fails to fulfill the aforesaid notification obligation within the specified time, he will no longer enjoy the financial discount on the loan from September 1 day after completing the graduation formalities of undergraduate (or junior college), and the borrower shall repay the principal and interest in strict accordance with this contract and the corresponding agreed repayment plan.

Twenty-second borrowing students can not complete their studies normally due to reasons such as dropping out of school, leaving school, going abroad, being expelled from school, etc. , and shall promptly notify the agency. With the consent of the Development Bank, the agent bank has the right to take measures such as stopping the issuance of loans and recovering the principal and interest of loans in advance on behalf of the Development Bank. The Borrower shall bear the principal and interest from 1 day (including 1 day) following the date of handling the above-mentioned relevant procedures; When the borrowing students who have dropped out of school resume their studies, the starting date for resuming the discount is the current month 1.

Chapter VII Handling of Students in Default

Article 23 A defaulting student refers to a student who has defaulted on the due principal and interest for more than one year after entering the repayment period, and has not contacted the aid center to handle the relevant formalities.

Twenty-fourth in accordance with the student loan contract, the development bank, the provincial student aid office and the county student aid center have the right to take the following measures without notifying the defaulting students:

(1) If the borrower fails to repay the loan within the time limit and amount agreed in the loan contract, the handling bank will charge a penalty interest on the amount of the default repayment;

(2) The handling bank will enter the default information into the basic database of personal credit information of the People's Bank of China for all financial institutions in China to inquire according to law. Take restrictive measures against defaulting borrowers who maliciously default on loans and refuse to provide financial services such as housing loans and auto loans;

(3) Publish the list of students who violate the contract on the college students' employment network, academic diploma inquiry website and national student loan website;

(4) Publish relevant information about students who break the contract on campus network and alumni network, and inform the employer of the situation.

(5) Lenders who seriously breach the contract will also bear relevant legal responsibilities.

Chapter VIII Others

Article 25 If the provincial aid office, county aid center, agency bank and other relevant departments violate these measures and fail to perform their duties in the application and disbursement of risk compensation and discount interest funds, the development bank has the right to take measures such as suspending the issuance of loans and deducting risk compensation.

Twenty-sixth due to changes in national policies, these measures can not continue to be implemented, the two sides should negotiate to solve.

Article 27 If there are other unforeseeable factors that affect the implementation of the relevant agreed matters in these Measures, both parties shall notify each other in writing in time, and settle them through friendly negotiation, and modify these Measures accordingly.

Twenty-eighth county-level funding centers can formulate corresponding implementation rules according to their own actual conditions.

Article 29 These Measures shall be interpreted and revised by Qinghai Branch of China Development Bank and Qinghai Student Financial Assistance Management Office, and shall be implemented as of the date of issuance.
