Legal analysis: If the wife buys a house before marriage, the party concerned now buys a house as a second suite, and the definition of the second suite has the following three situations:

1, the loan was used to buy a suite of commercial loans but it was not settled, and then the loan was used to buy a house;

2. There are two commercial loan records in the personal name, one of which has been paid off and the other has not been paid back;

3. Husband and wife, one party used commercial loans before marriage, the other party used provident fund loans before marriage, and wanted to borrow in the name of husband and wife after marriage, but more than two sets of loans were not paid off.

Legal basis: Article 1062 of the Civil Code of People's Republic of China (PRC), the following property acquired by husband and wife during the marriage relationship is the common property of husband and wife and belongs to them:

(1) Wages, bonuses and remuneration for labor services;

(2) Income from production, operation and investment;

(3) Income from intellectual property rights;

(4) Inherited or donated property, except as provided for in Item 3 of Article 1063 of this Law;
