Vehicles belong to movable property. If the borrower mortgages the vehicle and delivers it to you when borrowing from you, it is legally a chattel pledge. This undertaking is legal and valid. You have the legal pledge right, and you can legally take possession of the vehicle as pledge. No other individual or unit has the right to ask you to hand over your vehicle as a pledge. If the court asks you to hand over the vehicle, you also have the right to refuse. However, the court can still seize the vehicle and you have the right to pay the vehicle handling fee in the future.
