Measures for the Administration of Public Security in the Acquisition of Scrap Metals Article 1 These Measures are formulated in order to strengthen the administration of public security in the acquisition of scrap metals, protect legitimate business operations and prevent and crack down on illegal and criminal activities. Article 2 The term "scrap metal" as mentioned in these Measures refers to productive scrap metal and unproductive scrap metal. The specific classification of productive scrap metal and unproductive scrap metal shall be stipulated by the Ministry of Public Security jointly with relevant departments. Article 3 Productive scrap metal shall be purchased by enterprises with the right to purchase productive scrap metal in accordance with the relevant regulations of the State Council. Other enterprises and individual industrial and commercial households that purchase scrap metal can only purchase unproductive scrap metal, and may not purchase productive scrap metal. Article 4 An enterprise that purchases productive scrap metal shall, with the approval of the competent business department, apply to the public security organ of the local people's government at the county level for issuing a special trade license, and apply to the administrative department for industry and commerce at the same level for registration before starting business. Enterprises and individual industrial and commercial households that purchase unproductive scrap metal shall apply to the administrative department for industry and commerce of the local people's government at the county level for registration, obtain a business license, and file with the public security organ at the same level before starting business. Article 5 An enterprise purchasing scrap metal shall have a fixed business place. Individual industrial and commercial households purchasing scrap metal shall have permanent or temporary residence.
