Third, the legal content of the pre-loan investigation

(1) Review the legal status of the borrower, including its legal establishment and continuous and effective existence. Pay attention to whether the relevant certificates have passed the annual inspection or related verification.

(3) Regarding the borrower's loan situation, whether the borrower has opened basic account and general deposit accounts in accordance with relevant laws and regulations; Whether the foreign investment of the borrower (such as a company) exceeds 50% of its net assets; Whether the borrower's debt ratio meets the requirements of the lender;

Article 148

If a party commits a civil legal act that goes against its true meaning by fraudulent means, the injured party has the right to request the people's court or an arbitration institution to cancel it.

Article 149

If a third party commits fraud, causing one party to commit a civil legal act against its true meaning, and the other party knows or should know about the fraud, the defrauded party has the right to request the people's court or an arbitration institution to cancel it.

Article 150

If one party or a third party coerces the other party to carry out a civil legal act against its true meaning, the coerced party has the right to request the people's court or an arbitration institution to cancel it.

Article 192

Article 266
