Chapter I General Provisions Article 1 In order to further optimize the development environment of small and medium-sized enterprises, safeguard their legitimate rights and interests, promote their healthy development, and give full play to their important role in economic and social development, these Regulations are formulated in accordance with the Law of People's Republic of China (PRC) on the Promotion of Small and Medium-sized Enterprises and other laws and administrative regulations, combined with the actual situation of this province. Article 2 These Regulations shall apply to the work of promoting the development of small and medium-sized enterprises within the administrative region of this province.

The term "small and medium-sized enterprises" as mentioned in these Regulations refers to enterprises established in accordance with the law within the administrative region of this province, whose production and operation scale meet the national classification standards for small and medium-sized enterprises. Article 3 The people's governments at or above the county level shall incorporate the development of small and medium-sized enterprises into the national economic and social development plan, determine the key industries and fields to be supported, and formulate corresponding policies and measures to create a good environment for promoting the development of small and medium-sized enterprises.

The provincial and municipal people's governments set up a leading group for the development of small and medium-sized enterprises (non-public economy), and the office is located in the administrative department of small and medium-sized enterprises. The main responsibility of the leading group is to coordinate and solve major problems in the development of small and medium-sized enterprises. Article 4 The administrative departments of small and medium-sized enterprises of the people's governments at or above the county level shall be responsible for organizing the implementation of these Regulations, comprehensively coordinating, supervising, guiding and serving the work of small and medium-sized enterprises within their respective administrative areas, and guiding and encouraging their development.

The relevant departments of the people's governments at or above the county level shall do a good job in promoting the development of small and medium-sized enterprises in accordance with their respective responsibilities. Article 5 The people's governments at or above the county level may reform the property rights and other systems of qualified small and medium-sized state-owned enterprises.

Non-public enterprises can participate in the restructuring and transformation of state-owned and collective enterprises through mergers and acquisitions, equity participation and other forms. Article 6 The legitimate rights and interests of small and medium-sized enterprises such as property rights, management rights and fair competition rights are protected by law, and no unit or individual may infringe upon them.

Small and medium-sized enterprises shall operate in accordance with the law, be honest and trustworthy, and shall not harm the public interests of the state and society or infringe upon the legitimate rights and interests of employees. Chapter II Entrepreneurship Support Article 7 People's governments at all levels shall protect small and medium-sized enterprises from participating in market competition according to law. Small and medium-sized enterprises can invest and operate in industries and fields that are not prohibited by laws and administrative regulations. Article 8 People's governments at all levels shall formulate and improve policies and measures to encourage the establishment of small and medium-sized enterprises and support the establishment of various small and medium-sized enterprises. Guide all kinds of professionals to flow to small and medium-sized enterprises.

Encourage intangible assets such as intellectual property rights to participate in the establishment of small and medium-sized enterprises. Where intangible assets such as intellectual property rights are assessed and valued to participate in the establishment of small and medium-sized enterprises, the proportion of capital contribution to the registered capital (working capital) of the enterprise may be agreed upon by all investors through consultation, unless otherwise stipulated by laws and regulations. Article 9 The administrative department in charge of small and medium-sized enterprises shall strengthen entrepreneurship guidance and services for small and medium-sized enterprises, provide policy advice and entrepreneurship training for entrepreneurs, and give play to the role of entrepreneurship guidance experts and social entrepreneurship service institutions in entrepreneurship consultation, entrepreneurship agency and training. Tenth people's governments at or above the county level shall, according to the needs of the development of small and medium-sized enterprises in urban and rural planning, reasonably arrange venues and facilities to support the establishment of small and medium-sized enterprises.

Support all kinds of capital to use existing development zones, high-tech industrial parks, idle factories and other stock assets to build small and medium-sized enterprise parks, and provide places and related supporting services for the establishment of small and medium-sized enterprises. Article 11 If starting a small enterprise meets the conditions for promoting employment, it may apply to the local administrative department of human resources and social security and the financial department for a certain amount of small secured loan funds and interest subsidies. Twelfth people's governments at or above the county level support small and medium-sized enterprises to create jobs, and give policy support to small and medium-sized enterprises that attract more employees. Small and medium-sized enterprises can apply for social insurance subsidies to local human resources and social security administrative departments if they recruit local people with employment difficulties, sign labor contracts for more than one year and pay social insurance premiums for them. Thirteenth small and medium-sized enterprises due to production characteristics or special needs of work, after consultation with employees, can apply to the administrative department of human resources and social security for the implementation of flexible working hours or comprehensive working hours. Chapter III Financial Support Article 14 Special funds for the development of small and medium-sized enterprises shall be arranged in the financial budgets of provinces and cities (prefectures), and increased with the growth of financial resources; Conditional county (city) level budget should also arrange special funds for the development of small and medium-sized enterprises.

Special funds for the development of small and medium-sized enterprises shall be used and managed by the administrative department of small and medium-sized enterprises in conjunction with the financial department. Special funds for the development of small and medium-sized enterprises shall be earmarked for special purposes and shall not be misappropriated or withheld. Fifteenth provincial and municipal people's governments can take the form of capital injection to support local commercial banks to increase credit input to small and medium-sized enterprises.

Reward financial institutions that have made outstanding achievements in providing financial services for small and medium-sized enterprises. Article 16 People's governments at or above the county level and their relevant departments shall establish a communication and coordination system with financial institutions, guide and encourage financial institutions to give credit support to small and medium-sized enterprises that meet the national and provincial industrial policies and have high credit ratings, and guide and encourage financial institutions to develop financial products and services that meet the development needs of small and medium-sized enterprises. Seventeenth provincial and municipal people's governments shall set up credit guarantee risk compensation funds for small and medium-sized enterprises, and give risk compensation to guarantee institutions that provide loan guarantees for small and medium-sized enterprises.

Support the people's governments at the county level to set up credit guarantee institutions for small and medium-sized enterprises to provide guarantee services, timely replenish capital for credit guarantee institutions for small and medium-sized enterprises with outstanding performance, and gradually improve their guarantee capacity.

Guide social capital to participate in the construction of credit guarantee system for small and medium-sized enterprises, and encourage the development of mutual financing guarantee for businesses and enterprises. Small and medium-sized enterprise credit guarantee institutions provide guarantees for small and medium-sized enterprises, and the provincial and municipal people's governments shall give financial support if they meet the relevant conditions.
