According to the laws of our country, except the courts, procuratorial organs, public security, customs, security, taxation and other organs, the accounts of units or individuals can be frozen in accordance with legal procedures under the circumstances authorized by law, and any other department, including banks, has no right to freeze other people's accounts under any circumstances.

However, there is one exception. For example, there is an agreement in a bank loan contract that the bank has the right to freeze the customer's deposit account in the bank if it fails to repay the loan in time after a certain period.

Note that this is only under the conditions stipulated in the contract, and the bank has no right to freeze the deposit accounts of other banks. This situation generally exists between companies and big customers, and ordinary borrowers need not worry.

Do banks need to freeze their accounts if they have debt loans?

If the borrower is in debt and applies for a bank loan at this time, the bank will strictly examine the repayment ability of the user. For example, the user's debt has exceeded half of the monthly income. At this time, it is undoubtedly impossible to repay the loan, and the risk of overdue is great, so the bank will not lend to users. Unless the user submits additional financial proof, the bank will reconsider.

In addition, when the debt ratio is too high to apply for a loan, you can pay off part of the loan first, so that the debt will be reduced, and then applying for a loan may pass the examination.

What I owe is that the loan company has not paid back the money. Will the bank freeze my bank account?

It is not impossible to freeze bank accounts, as long as the court decides, it can be executed.

To borrow money from your account, the lender is your account (company) to the bank. If the repayment cannot be made in time, there is also a dunning period, usually three months. If the loan cannot be repaid in time, the bank will generally auction the property mortgaged by the loan first. If there is no collateral, the bank will sue your account (company), and your account (company) may be frozen at this time. Generally speaking, an individual's bank account will not be frozen unless the lender is an individual. Once the loan company sues, it will inquire about the property under the loan name for repayment.

What are the consequences of the loan money?

1. If it is really unable to repay, it shall negotiate with the lending institution to extend the repayment period or repay it in installments;

4. If the lender refuses to perform the effective judgment of the court because there is no executable property under his name, negative information such as overdue repayment will be recorded in the personal credit report, restricting his high consumption and entry and exit, and may even be entrusted with the loan by the judiciary.

What are the consequences of overdue?

1. When you pay your mortgage overdue, the bank will initially urge you to pay it back quickly, and will add corresponding penalty interest according to your overdue situation. This is not a good thing for buyers, it will only greatly increase the cost of buying a house and spend more money. If you still refuse to repay the mortgage after repeated urging, you are likely to face legal proceedings.

2. If the bank can't recover the corresponding loan, it will apply to the court for compulsory recovery of your house and auction it at a low price, so that the house you have worked so hard to buy will also be owned by others. Moreover, the auction proceeds will only be owned by the buyer after a series of expenses such as bank loans and legal fees have been settled.

If your house is auctioned at a low price, neither the bank nor the developer will pay you the down payment. In this way, you will not only lose your house, but also pay the down payment for nothing.

4. According to the Credit Management Regulations of the State Council Legislative Affairs Office, the retention period of "bad records" is 5 years. If it has been more than 5 years, the credit reporting agency shall be deleted. However, the credit record will be deleted after 5 years only after the arrears are paid off.
