The maximum monthly interest rate of private lending is 3%, and the monthly interest rate is protected by national laws within 3%, and it is invalid if it exceeds 3%. Therefore, when handling private lending, we must clearly see the agreed loan interest rate. If the interest rate is beyond the scope of legal protection, we need to negotiate with the lender in time. Article 26 of the Supreme People's Court's Provisions on Several Issues Concerning the Application of Laws in the Trial of Private Lending Cases states that if the interest rate agreed by both borrowers and lenders does not exceed 24% per annum, and the lender requests the borrower to pay interest at the agreed interest rate, the people's court shall support it.
