In violation of discipline and law, Article 59 of the Civil Servant Law of the People's Republic of China stipulates: Violating relevant regulations to engage in or participate in for-profit activities and hold concurrent positions in enterprises or other for-profit organizations.

If a public official makes private loans and fails to repay the loan within the due date, the creditor may require the public official to repay the loan. If the public official fails to repay the loan, the creditor may file a lawsuit in court.

Scope of application The People's Court shall apply the provisions of this Law when accepting civil lawsuits between citizens, legal persons, other organizations, and between them due to property relations and personal relations.

A lawsuit must meet the following conditions:

(1) The plaintiff is a citizen, legal person or other organization that has a direct interest in the case;

(2) There is a clear defendant;

(3) There are specific litigation claims, facts and reasons;

(4) It falls within the scope of the people's court to accept civil litigation and the jurisdiction of the people's court subject to the lawsuit.

What are the types of administrative penalties for civil servants

(1) Warning. Provide warnings to those who violate administrative disciplines, so that they can understand their administrative responsibilities, so that they can be vigilant, pay attention to and correct their mistakes, and avoid making such mistakes again. This kind of punishment is applicable to those who violate administrative disciplines with minor violations.

(2) Demerits. To record or register a fault to indicate punishment. This kind of punishment is applicable to those who violate administrative disciplines in relatively minor ways.

(3) Record a major demerit. Recording or registering larger or more serious faults with the intention of serious punishment. This kind of punishment is applicable to those who have serious violations of administrative disciplines and caused certain losses to the country and the people.

(4)Downgrade. lower their salary grade. This kind of punishment applies to those who violate administrative disciplines and cause certain losses to the interests of the country and the people, but can still continue to hold their current positions.

(5)Removal. Remove current position. This kind of punishment is applicable to those who have serious violations of administrative disciplines and are no longer suitable to hold their current positions.

(6) Dismissal. Removed from public office. This kind of punishment applies to those who have made serious mistakes and have lost their basic conditions as state workers.
