Chapter I General Provisions
Article 1 is to implement the Opinions of the State Council on Establishing and Perfecting the Financial Aid Policy System for Students from Poor Families in Colleges, Higher Vocational Schools and Secondary Vocational Schools (Guo Fa [2007]13) and the Implementation Opinions of Sichuan Provincial People's Government on Establishing and Perfecting the Financial Aid Policy System for Students from Poor Families in Colleges, Higher Vocational Schools and Secondary Vocational Schools (Chuan Fu Fa [2007] No.43). In order to implement the spirit of the Notice of the Ministry of Finance, the Ministry of Education and the China Banking Regulatory Commission on Vigorously Developing Student-origin Credit Student Loans (Cai Jiao [2008]196), further improve the financial aid policy system for students with financial difficulties, and effectively promote the work of national student loans in our province, these Trial Measures are formulated.
Article 2 Student-origin credit student loans refer to student loans issued by approved banking financial institutions (hereinafter referred to as "handling banks") to eligible freshmen in institutions of higher learning and students with financial difficulties (hereinafter referred to as "students"), and handled by the counties (cities, districts) where the students registered before entering school. Student loans are credit loans, and students and their parents (or other legal guardians) are the same borrower, and both parties are responsible for repayment.
Article 3 Sichuan Branch of China Development Bank is the main provider of credit student loans for students in Sichuan Province. Other banking financial institutions can carry out this business with the consent of the Provincial Department of Education, the Provincial Department of Finance and the Sichuan Banking Regulatory Bureau.
Chapter II Loan Objects and Conditions
Article 4 Student-origin credit student loans are issued to ordinary college students with financial difficulties.
Article 5 Students applying for student-origin credit student loans must meet the following conditions:
1. has the nationality of the people of China;
2. Honest and trustworthy, law-abiding;
3. Freshmen, graduate students and students with a second bachelor's degree who have been officially admitted to full-time ordinary undergraduate colleges, higher vocational schools and junior colleges (including private colleges and independent colleges, the list is subject to the announcement of the Ministry of Education) that have been approved to set up and implement higher education according to the relevant provisions of the state, and have obtained a true, legal and effective admission notice;
4. Students' pre-school household registration and their parents' (or other legal guardians') household registration are in the county (city, district);
The family is in financial difficulties, and the income they can get is not enough to cover the basic expenses needed to complete their studies during school.
Article 6 A student's family applying for a student-origin credit student loan shall meet the following conditions:
1. No bad credit record;
2. Family financial difficulties should generally meet one of the following basic characteristics:
(1) Rural poor households and urban low-income households;
(2) Orphans and disabled families;
(3) Poor single-parent families with no stable income;
(4) Families where one or both parents are unemployed;
(5) Suffering from major disasters, causing serious losses and unable to afford the students' fees;
(6) Family members suffering from serious diseases;
(7) the creator of the main income of the family loses the ability to work for some reason;
(8) Families with total annual cash income less than 8,000 yuan;
(9) Other poor families.
Chapter III Loan Policy
Seventh students' credit student loans shall be applied, approved and issued on an annual basis. The loan each borrower applies for each year generally does not exceed the sum of tuition and accommodation fees charged by the school, with a maximum of 6,000 yuan, which is mainly used to solve the problem of tuition and accommodation fees for students at school.
Students who have obtained credit student loans from their places of origin may not apply for national student loans from ordinary colleges and universities in the same academic year; Students who have obtained national student loans from institutions of higher learning are not allowed to apply for student-origin credit student loans in the same academic year.
Article 8 In principle, the term of student-origin credit student loans shall be determined according to the full-time undergraduate academic system plus 14 years, and the longest term shall not exceed 14 years. Among them, students are determined according to the remaining years of study plus 10 years. For those who have studied for more than 4 years or continue to study for a postgraduate degree or a second bachelor's degree, the repayment period after graduation will be shortened accordingly.
Article 9 The interest rate of student-origin credit student loans shall be subject to the benchmark interest rate of the same period and grade published by the People's Bank of China, and shall not go up.
Tenth students credit student loan interest charged annually. Students' interest during school is fully subsidized by the finance, and the interest after graduation is shared by the students and their parents (or other legal guardians). The grace period is the two years after students' graduation (only interest is paid, and the principal is not repaid). After the grace period is over, students and their parents (or other legal guardians) will repay the loan principal and interest in installments according to the loan contract.
Chapter IV Loan Discount and Risk Compensation
Article 11 The interest of loan students during their school days shall be fully subsidized by the finance. Among them, students admitted to universities directly under the central government and students admitted to local universities for inter-provincial study, their loan interest subsidies are borne by the central finance. Sichuan provincial students admitted to Sichuan provincial universities, the loan interest shall be borne by the provincial finance; Sichuan students admitted to the city (state) is a university, the loan interest shall be borne by the city (state) where the university is located. After graduation, students and their parents (or other legal guardians) will bear all interest.
Twelfth the establishment of special funds for risk compensation, according to the current loan amount 15% to determine the risk compensation ratio. The risk compensation for students admitted to universities directly under the central government and local universities across provinces shall be borne by the central finance; If Sichuan students are admitted to provincial universities, the central government will bear 75% of the loan amount, the provincial finance will bear 15%, and the students attending universities will bear 6%. When students from Sichuan Province are admitted to a city (state) university, 75% of the loan amount is paid by the central government, 15% by the city (state) where the university is located, and 6% by the students in school.
Article 13 The discount interest and risk compensation shall be collected by the Sichuan Provincial Student Financial Assistance Management Center and the municipal (state) student financial assistance management centers respectively, and shall be paid in full and on time to the handling banks that carry out student-origin credit student loans before February 20th of each year.
Article 14 When the handling bank receives the risk compensation, it is recognized as deferred income, and when the loss of the student loan is recognized, it is included in the current profit and loss. The loss of student loans that have been confirmed as the source of students, and then recovered, shall be transferred back to deferred revenue accordingly. If the risk compensation exceeds the loss of student credit loan, the excess shall be returned to the county-level student financial assistance management center by the handling bank to make up for the loss of non-performing loans; Less than the loss of student credit loan, the insufficient part is shared by the handling bank and the county-level financial department, in which the county-level financial sharing part first uses the funds returned by the handling bank to the county-level student financial assistance management center, and the insufficient part is borne by the county-level finance.
Chapter V Organization and Management
Fifteenth students' credit student loans work under the unified leadership of governments at all levels. All levels of education, financial departments, banking supervision departments and handling banks, as well as ordinary high schools and institutions of higher learning, should divide their work and cooperate closely to establish a benign operating mechanism for student-origin credit student loans.
Sixteenth provincial education departments should carefully arrange and organize, and urge education departments at all levels and ordinary high schools and institutions of higher learning to do a good job in the work of credit student loans for students. On the basis of integrating the existing resources, the education departments of cities and counties should establish and improve the student financial assistance management institutions, arrange specialized personnel and necessary working funds, ensure the necessary working conditions, and actively carry out the work of student-origin credit student loans. The county-level student financial assistance management center is responsible for collecting, sorting out and summarizing information such as students' family economic status and students' demand for credit student loans; Investigate and identify the family economic status of the loan students; Set up a student credit and loan qualification evaluation team to determine the list of students who meet the loan conditions; Calculate the loan demand and prepare the loan plan; Handle the application and preliminary examination of student-origin credit student loan; Accept the entrustment of institutions of higher learning, students' credit student loans and national student loan handling banks, establish a contact system with loan students' families, and track the changes in the economic situation of loan students' families; Entrusted by the provincial branch of the Development Bank to repay the loan; Responsible for regularly submitting the relevant information of loan students to the superior student financial assistance management center, universities and handling banks, strengthening communication with universities and avoiding repeated loans.
Relevant high schools should cooperate with the county-level student financial assistance management center and the handling bank to provide students with college entrance examination enrollment and the demand for credit student loans from students' places of origin, and assist in the application, approval and issuance of loans. Relevant institutions of higher learning should strengthen the honesty education for students, cultivate students' honesty awareness, and educate students to fulfill their repayment obligations according to the contract after graduation; And the student loan information will be included in the credit information system management of China People's Bank. According to the needs of the relevant county-level student financial assistance management centers, assist in providing relevant information of students with credit student loans from their places of origin and information of charging accounts in colleges and universities.
Article 17 The financial departments of provinces and cities (prefectures) shall fully arrange discount interest funds and risk compensation in the annual financial revenue and expenditure budget, strengthen the management, use and supervision of discount interest funds and risk compensation, and improve the efficiency in the use of funds.
Article 18 The handling bank is responsible for scientifically and reasonably designing the loan method and term structure, formulating the operating rules for student-origin credit student loans, reviewing, issuing and managing loans, ensuring smooth loan channels, and enabling eligible students with financial difficulties who need loans to apply for student-origin credit student loans. In conjunction with the finance and education departments, according to the characteristics of student-centered credit student loans at different stages, the information and credit connection between student-centered loan products, families, universities and employment units will be established to form the credit management of the whole process of student loans. The handling bank may, through entrustment, be assisted by other financial institutions in settlement management, and pay agency fees according to the entrustment agreement. Agent banks and branches should provide high-quality and efficient services for credit loans of origin.
The handling bank should establish a full-time management institution for student-origin credit student loans and be equipped with sufficient personnel, formulate specific implementation measures according to the relevant provisions of the national student loan management, effectively prevent loan risks, and maintain the sustainable development of student-origin credit student loans.
Article 19 Banking supervision and management departments shall, jointly with finance and education departments, guide banking financial institutions to carry out student-origin credit loan business, conduct regular inspections and evaluations, and urge the handling banks to improve financial services and improve work efficiency.
Chapter VI Supplementary Provisions
Twentieth student loans have been handled according to the "Trial Measures for the Management of Student Loans in Sichuan Province" formulated by the Chengdu Branch of the People's Bank of China and other five departments, and they are still implemented according to the original measures, and no new loans will be handled since the implementation of these measures.
Twenty-first these Measures shall be interpreted by the Provincial Department of Education, the Provincial Department of Finance and the Sichuan Banking Regulatory Bureau.
Article 22 These Measures shall be implemented as of the date of promulgation.
