During the mortgage period, the ownership of the house belongs to the bank. Housing mortgage belongs to real estate mortgage, which refers to the mortgage set with real estate as the mortgage subject matter. Real estate mortgage is the most common form of mortgage. Because of the particularity of real estate, the mortgagor can realize the purpose of guarantee without transferring his possession, so it is widely welcomed by the society in practice. Article 191 of the Property Law: During the mortgage period, if the mortgagor transfers the mortgaged property with the consent of the mortgagee, he shall pay off the debt to the mortgagee in advance or deposit the proceeds from the transfer. The part of the transfer price exceeding the amount of creditor's rights belongs to the mortgagor, and the insufficient part is paid off by the debtor. During the mortgage period, the mortgagor shall not transfer the mortgaged property without the consent of the mortgagee, except that the transferee pays off the debts and eliminates the mortgage on his behalf.
Therefore, it is forbidden to dispose of the property during the mortgage period. If the house is demolished, the transferee needs to pay off the debt on his behalf. Or the mortgagor pays off debts and eliminates the relationship between creditor's rights and debts.
