If the demolished houses are given the right to houses and cannot be sold without requirements, then such demolished houses are no different from ordinary commercial houses, and such demolished houses are allowed to be traded. According to the regulations, the demolished houses without real estate license belong to real estate, and the property rights of real estate are registered for the record. Without registration, except in special circumstances, it does not have the legal effect of the term of property rights. Therefore, the demolition houses that have not yet obtained the real estate license cannot be sold to others, otherwise it is illegal.
The law stipulates that Article 39 of People's Republic of China (PRC) Urban Real Estate Management Law obtains the land use right certificate by means of transfer. When transferring the real estate industry, the following conditions shall be met: (1) All the land use right transfer fees have been paid in accordance with the transfer contract, and the land use right certificate has been obtained; (two) according to the commitment of the transfer contract, the development and design investment is a residential project, and more than 25% of the development and design investment belongs to a piece of development land, resulting in industrial land or other land standards. Can I buy a house by changing my mortgage to an account? Buying a house with a loan is a procedure to apply for the relocation of an account, but the prerequisites for an account in different places are different. Property buyers in the household registration, should hold the relevant documents to the police station. Those who are approved to buy a house should register at the police station after receiving the Certificate of Permission to Move in, and then register at the police station in registered permanent residence with the Certificate of Permission to Move in (third edition), household registration certificate and identity documents.
Step 1: The public security organ at the place where the mortgage loan is purchased shall apply. 2. At the same time, seriously sign the "permit for quasi-relocation", apply outside the examination and approval authority, and report to the household affairs unit of the Municipal Public Security Bureau with the examination opinions;
3. After receiving the report materials, the household administration unit of the Municipal Public Security Bureau must make a decision on approval or disapproval within 15 working days. Make a resolution of approval, at the same time, review and sign the "transportation permit";
4. The public security organ of the place of emigration shall notify the applicant within 2 working days after receiving the audit resolution of the portal website management unit of the Ministry of Public Security led by the superior;
5. The public security organ in the place of immigration shall examine and sign the migration certificate on the spot with the permit of quasi-migration, and pay attention to the cancellation of the account;
6. The public security bureau at the place of emigration shall go through the household registration formalities on the spot with the Permit and the Police Station Pass.
Mortgage loan must bring materials 1 and household application form to buy a house and move to an account;
2, the applicant's real estate license or financial institutions mortgage purchase credentials, purchase invoices, purchase contracts, real estate sales core information cancellation form;
3, the construction of housing did not apply for real estate license, to give the land and resources application certificate or the relevant confirmation of territorial units, the overall planning consent certificate, the project construction consent certificate;
4. The applicant's household registration book, resident identity card, marriage certificate and medical certificate of birth of minor children;
5. Residence certificate issued by the public security bureau where the applicant moves (if there is no transfer in this province, the connection must be confirmed if the family members enter the account).
