Measures of Beijing Municipality on the Administration of Public Rental Housing
Chapter I General Provisions

Article 1 In order to improve the housing supply system in our city, adjust the housing supply structure, implement both renting and selling, and meet the housing needs of some low-income families with housing difficulties through multiple channels, according to the Opinions of the State Council on Solving the Housing Difficulties of Urban Low-income Families (Guo Fa [2007] No.24) and Opinions on Promoting the Healthy Development of the Real Estate Market (Guo Ban Fa [2008]1365438).

Article 2 These Measures shall apply to the construction, distribution and management of public rental housing within the administrative area of this Municipality.

The term "public rental housing" as mentioned in these Measures refers to the housing that the government provides policy support, limits huxing area, supply targets and rent levels, and rents to low-and middle-income families with housing difficulties in this city.

Article 3 The construction, distribution and management of public rental housing shall follow the following principles: government support and market operation; Multi-party construction and unified management; Fair, open and strict supervision.

Chapter II Housing Raising

Fifth public rental housing by the city, district and county government agencies or agencies approved by the government through new construction, acquisition and other channels to raise.

Sixth new public rental housing should be based on one-bedroom and two-bedroom as the main body, centralized construction or combined construction.

Seventh public rental housing construction land for paid use, which is used for the construction of government-owned institutions or institutions approved by the government, the land can be leased and the annual land rent paid.

Article 8 Financial institutions support the construction and leasing of public rental housing in various ways, and relevant units may apply for loans from commercial banks, use trust funds, issue bonds and apply for entrusted loans from housing accumulation funds according to the prescribed conditions. In addition, social funds can also be raised through the reform of investment and financing methods, the lease of public rental housing and supporting facilities to recover funds, social donations and other funds approved by the municipal government.

Chapter III Rent Distribution Management

Ninth public rental housing supply targets for the city's low-income families with housing difficulties, including families who have passed the qualification examination of low-rent housing, affordable housing and price-limited commercial housing and other families with housing difficulties.

Tenth families who have passed the qualification examination of low-rent housing, affordable housing or price-limited commercial housing can directly apply for waiting for public rental housing at the neighborhood offices or township people's governments where their household registration is located.

Eleventh public rental housing public allocation system, by the property unit to prepare the allocation plan submitted to the housing security management department for approval before organizing the allocation. Among them, families who meet the conditions of low-rent housing, affordable housing and price-limited commodity housing and other family members who meet the conditions of renting can give priority to renting, including the elderly over 60 years old, seriously ill people, disabled people, demobilized soldiers, special care recipients or key project demolition personnel.

Twelfth families who meet the conditions of renting can only rent a set of public rental housing.

Chapter IV Lease Management

Thirteenth according to the principle of guaranteed profit, combined with the affordability of the tenant family and a certain proportion of the market rent of similar houses in similar lots, to determine the rent of public rental housing.

Fourteenth government agencies and institutions approved by the government to rent public rental housing according to the prescribed rent, who meet the relevant tax provisions of the state, can enjoy the relevant preferential tax policies.

Fifteenth public rental housing by the property unit maintenance, conservation and management, property units can also entrust professional service enterprises to manage.

Chapter V Supervision and Administration

Sixteenth public rental housing lease period is not more than five years, the tenant family should withdraw from the housing at the expiration of the contract. If the tenant family needs to continue renting, it should apply within 3 months before the expiration of the contract, and the property right unit will review the qualified renewal of the lease contract with the relevant units; If the leased family does not meet the lease conditions and cannot vacate the leased house temporarily, a two-month transition period will be given after the lease contract expires, and rent will be charged according to the market rent of similar houses in similar lots during the transition period. After the expiration of the transition period, if the leased family still does not withdraw from the leased house, the rent shall be charged according to the standards stipulated by the housing property unit, as specifically agreed in the lease contract; The refusal to quit is recorded in the credit file.

Seventeenth tenant families have one of the following acts, the property unit can terminate the lease contract with the tenant family, to recover the housing:

(1) Lending or subletting the leased house;

(two) to change the residential purpose of the leased house without authorization;

(three) for more than 6 months without living in the leased housing;

(4) Failing to pay the rent on schedule for more than 3 consecutive months;

(five) to obtain other forms of policy housing security;

(six) other violations of the lease contract.

Eighteenth in violation of the provisions of these measures, not truthfully declare the family housing and other conditions, defrauding the rental of public rental housing, the property unit to terminate the lease contract, the tenant family out of the housing and pay the rent according to the standards stipulated by the housing property unit; Cheating rent is recorded in the credit file, and you may not apply for policy housing within 5 years.

Article 19 If a property right unit fails to collect rent according to the stipulated rent standard or rents public rental housing to unqualified families without authorization during the lease contract period, the housing security management department shall order it to make rectification, return, make up the rent or recover the housing within a time limit.

Article 20 If the relevant staff members of the management department take advantage of their positions to accept other people's property or other benefits, or fail to perform their duties of supervision and management according to law, they shall be given administrative sanctions; If a crime is constituted, criminal responsibility shall be investigated according to law.

Chapter VI Supplementary Provisions

Article 21 An institution that rents public rental housing with the approval of the government shall formulate specific implementation rules such as application review, rent standard and rent distribution management according to these Measures, and report to the municipal housing security management department, and organize the implementation after the approval of the municipal housing and urban-rural construction department in conjunction with the municipal development and reform, planning, land resources and other departments.

Article 22 These Measures shall come into force as of August 6, 2009.
